APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a
Temporary Permit with Evergreen Management Group, Inc., effective October 19, 2010
through December 31, 2010, for the Deer Valley Safety Improvement Project, as
recommended by the Public Works Director.
FISCAL IMPACT:
There is no impact to the County General Fund. All funding comes from the project, 100%
Proposition 1B Highway Safety Improvement Program Funds.
BACKGROUND:
The Public Works Department, in conjunction with the East County Habitat Conservancy, is
requesting a Temporary Permit to enter on a private property along Deer Valley Road in
east County. The private property owner has requested the County and its designees
indemnify them while we are on their property. We believe the indemnification is a
reasonable request from the property owner and would be a limited liability since the work
is low intensity and only a day or two in duration.

The Temporary Permit
BACKGROUND: (CONT'D)
to Enter is necessary in order to collect dormant fairy shrimp (endangered species) eggs
which will be removed to an offsite location owned by the HCP Conservancy to create
occupied habitat. Successful habitat creation will benefit a future safety improvement
project along Deer Valley Road that is expected to have fairy shrimp impacts, and may
benefit additional projects in the HCP Service Area. The work will be done under a
permit from the U.S. Fish and Wildlife Service.
CONSEQUENCE OF NEGATIVE ACTION:
The HCP Conservancy may be delayed in their ability to create vernal pool habitat.
CHILDREN'S IMPACT STATEMENT:
