HomeMy WebLinkAboutMINUTES - 09282010 - C.14RECOMMENDATION(S): APPROVE and AUTHORIZE the Director of Airports, or designee, to execute, on behalf of the County, a lease between the County, as Lessor, and Caffino Express, LLC, as Tenant, for the lease of property located at 2301 Meridian Park Boulevard, Concord Area. FISCAL IMPACT: There is no negative impact on the General Fund. The amended lease permits the Airport Enterprise Fund to receive ground rent. In addition, the General Fund will continue to receive property, sales and possessory interest tax revenues from the lease. The ground rent will begin at $3,528.30 per month the first year, increasing to $3,750, $3,970, $4,190 and $4410 per month for Years 2 through 5, respectively. The ground rent will then increase annually by the CPI inflator. BACKGROUND: This Lease supersedes and replaces the lease between the County and EXS, Inc, dba Caffino, dated May 24, 1994. The tenant has the right to request two additional five-year extensions of the lease term, which the County may deny in its sole discretion. The Lease will permit a continuation of desired commercial gourmet coffee/espresso services at the Buchanan Field Airport. This use is consistent with the policies identified within the Buchanan Field Airport Master Plan. Further, the Lease will provide rental and sales tax revenue to the Airport Enterprise Fund and County General Fund. CONSEQUENCE OF NEGATIVE ACTION: The County General Fund and the Airport Enterprise Fund would not realize additional revenues. CHILDREN'S IMPACT STATEMENT: Not applicable ATTACHMENTS Caffino Lease
