(4660-6X4109) AUTHORIZE the Public Works Director, or designee, to execute said Right of Way Contract-Temporary Easement on behalf of the County. DIRECT the Real Property Division to have said Grant of Easement recorded in the Office of the County Recorder. FISCAL IMPACT: There is no impact to the County General Fund. The activity is funded by Redevelopment Agency (RDA) Funds 74.9%, State Transportation Improvement Program-Transportation Enhancement (STIP-TE) Funds 18.9%, Transportation Development Act (TDA) Grants 3.6%, Community Development Block Grant Program (CDBG) 2.6%. Bueren, Public Works Director/Chief Engineer Date:September 28, 2010 Contra Costa County Subject:Montalvin Manor Pedestrian and Transportation Access Improvements BACKGROUND: The purpose of the project is to improve mobility in the Montalvin Manor area by closing sidewalk gaps on San Pablo Avenue between Shamrock Drive to Kay Road and on Kay Road from San Pablo Avenue to Rachel Road, providing Class II bike lanes and bus shelters along the west side of San Pablo Avenue. This project will improve pedestrian circulation along the heavily traveled San Pablo Avenue by providing a dedicated sidewalk for pedestrians. This project will also provide additional pavement width needed for a Class II bike facility along the west side of San Pablo Avenue. In addition, new drainage facilities will be constructed to collect and convey storm water within the project limits, which include storm drains, inlets, concrete valley gutters and outfall structures. As a condition of the easement EBMUD has required the County to indemnify EBMUD. CONSEQUENCE OF NEGATIVE ACTION: The County will not have sufficient land rights to complete the drainage improvements with approved plans and specifications.
