FISCAL IMPACT:
There is no cost associated with the retitlement of Health Services Systems
Director-Exempt and the Assistant Health Services Systems Director-Application
Software-Exempt classifications or exempting the four new director classifications from
the merit system.
BACKGROUND:
Health Services requested the retitlement and establishment of new information
technology classifications in order to comply with the American Reinvestment and
Recovery Act of 2009. Provisions under the American Reinvestment and Recovery Act
of 2009, are making available Federal and State funding to health care organizations, and
hospitals that provide services to Medicare and Medicaid beneficiaries to accelerate the
adoption and use of "certified electronic health record technology" replacing paper
medical records by 2014. (H.R. 1, 111th Cong. §§ 4001-4201 (2009).
The four (4) new Assistant Health Services Information Systems Directors will be
responsible for setting highly critical policies and procedures for the management and
protection of information technology; security of the department’s integrated health
computer application systems, including medical information; and the reliance of other
Department multiple divisions on the information technology and it’s managerial
personnel expertise to manage, secure and protect all computerized systems and data,
including medical/clinical systems, and billing system. All systems and databases include
confidential patient medical information utilized in the delivery of patient care services
and general operational functions for the entire department.
CONSEQUENCE OF NEGATIVE ACTION:
If the recommendation is not accepted a hearing will not take place and these
classifications will not be properly reflected in the County Ordinance Code and the
County may not be in compliance with the Merit System.

Information Technology Director-Information Security-Exempt)
The Contra Costa County Board of Supervisors ordains as follows (omitting the
parenthetical footnotes from the official text of the enacted or amended provisions of the
County Ordinance Code):
SECTION I: Section 33-5.313 of the County Ordinance Code is amended to exclude
from the merit system the classifications of Contra Costa Regional Medical Center Chief
Executive Officer-Exempt, Chief Medical Officer-Exempt, Ambulatory Care Chief
Executive Officer-Exempt, and Chief Quality Officer-Exempt, to read:
33-5.313. Health-medical.
(a) The director of health services is excluded and is appointed by the board.
(b) The county health officer (Health and Safety Code Section 454) is excluded
and is appointed by the board.
(c) The county physician (Health and Safety Code Section 1441) is excluded and
is appointed by the board.
(d) The county (local) director of mental health services (Welfare and Institutions
Code Section 5607, 9 Cal. Admin. Code Sections 620, 621 [Dir. of Local Mental
Health Services] is excluded and is appointed by the board.
(e) The assistant to the health services director-exempt is excluded and is
appointed by the director of health services.
(f) The assistant directors of health services are excluded and are appointed by
the director of health services.

(g) Physicians and dentists serving the county (except those in the
classifications of assistant health officer, and chief of community health services)
are excluded and are appointed by the director of health services.
(h) The health services administrative officer is excluded and is appointed by the
director of health services.
(i) The medical director is excluded and is appointed by the board upon the
recommendation of the director of health services and the county administrator.
(j) The director of marketing, member services, and public relations-Contra
Costa Health Plan is excluded and is appointed by the director of health services.
(k) The Contra Costa Regional Medical Center chief executive officer-exempt is
excluded and is appointed by the director of health services.
(l) The health services personnel officer-exempt is excluded and is appointed by
the director of health services.
(m) The alcohol and other drug services director-exempt is excluded and is
appointed by the director of health services.
(n) The chief medical officer-exempt is excluded and is appointed by the director
of health services.
(o) The mental health medical director-exempt is excluded and is appointed by
the director of health services.
(p) The executive assistant to the hazardous materials commission-exempt is
excluded and is appointed by the director of health services.
(q) The health plan services assistant-exempt is excluded and is appointed by
the director of health services.
(r) The mental health education liaison-exempt is excluded and is appointed by
the director of health services.
(s) The deputy executive director, Contra Costa Health Plan-exempt is excluded
and is appointed by the director of health services.
(t) The director of environmental health services is excluded and is appointed by
the director of health services.
(u) The director of hazardous materials programs-exempt is excluded and is
appointed by the director of health services.

(v) The chief executive officer, Contra Costa Health Plan-exempt is excluded
and is appointed by the director of health services.
(w) The residency director-exempt is excluded and is appointed by the director
of health services.
(x) The Contra Costa Health Plan medical director is excluded and is appointed
by the director of health services.
(y) The chief operations officer-exempt is excluded and is appointed by the
director of health services.
(z) The health services information technology director-exempt is excluded and
is appointed by the director of health services.
(aa) The assistant health services information technology director-project
management-exempt is excluded and is appointed by the director of health
services.
(bb) The assistant health services information technology director-application
development-exempt is excluded and is appointed by the director of health
services.
(cc) The assistant health services information technology director-customer
support-exempt is excluded and is appointed by the director of health services.
(dd) The assistant health services information technology director-infrastructure-
exempt is excluded and is appointed by the director of health services.
(ee) The assistant health services information technology director-information
security-exempt is excluded and is appointed by the director of health services.
(ff) The ambulatory care chief executive officer-exempt is excluded and is
appointed by the director of health services.
(gg) The chief quality officer-exempt is excluded and is appointed by the director
of health services.
