DIRECT the Auditor-Controller's Office to issue a warrant to the City of San Ramon in the amount of $46,252. FISCAL IMPACT: 100% Dougherty Valley Regional Enhancement Funds. Funds generated from developer fees from the Shappell Industries Project in the Dougherty Valley. BACKGROUND: Dougherty Valley was comprised of approximately 6000 acres of unimproved land in the unincorporated area of southwest Contra Costa County contiguous to the City of San Ramon and the Town of Danville and just North of the Contra Costa-Alameda County line. The Dougherty Valley Village Center is located in the heart of Dougherty Valley and encourages the convergence of pedestrian, vehicular and transit linkages. The project consists of three phases to be completed over a period of ten years. Upon its completion, the Village Center will consist of 528,100 square feet of community serving civic and retail uses. The first phase of the Village Center includes the Dougherty Valley Community Center, Library, Community College and Acorn Learning Center. There is a Village Center reciprocal easement which governs the use of the shared properties and responsibilities for shared improvements (including driveways, parking lots, landscaped areas, parking lot lighting, utilities) at the Village Center between the current three owners: City of San Ramon, Contra Costa Community College District and Larry/Virginia Goss, owners of Acorn Learning Center. The Contra Costa County Library is not one of the owners. They are a tenant of the City whose services are offered in the City-owned building. The Village Center owners and tenant (Library) meet regularly to discuss areas of concern and implementation of the Village Center agreements and shared use of the site. Over the past two years, enrollment and participation of the programs and services of the City, the College, Acorn Learning Center, and the Library have continued to grow. College enrollment is at capacity. Parking to accommodate all of the uses adequately has become a growing concern. The problem is exacerbated by the use of the parking lot for park and ride purposes by Dougherty Valley residents, as well as drop off and pick up for Windemere Ranch Middle School students after school. The start of the college term is a particularly bad situation. With inadequate parking, other safety and traffic concerns become more pronounced, such as cars circling the lot looking for a parking space. The City has completed a parking study to determine if there are solutions for more effective parking, and more effective safety measures such as timed parking, limited parking for designated users, as well as additional signage, safety signs, crosswalks, speed humps, etc. The addition of temporary parking in addition to some other recommended changes will result in a safer site, with more space available. The most optimum solution is to create a temporary parking lot of approximately 100-150 stalls on property owned by Shapell Industries at the most northerly end of the property to the west of the property line in vacant land. It is expected to be used by the College students primarily due to the proximity to the college, however it will be retained as parking for any of the Village Center/public uses. This parking lot will be available until such time as Shapell Industries begins construction of their commercial/retail space. The City, College District and Shapell will enter into a License Agreement to that effect allowing use of the parking lot for at least three years. Shapell has agreed to construct the parking lot utilizing their contractor, White Oak Landscape. The City has agreed to provide grindings to the project site that are left over from the City's pavement management projects currently underway. The College has agreed to modify existing parking lot lighting to provide lighting to the temporary lot, as well as provide any required security or supervision of the lot, as they would be the parking lots used by their students. The City of San Ramon will pay Shapell Industries for the costs of the construction of the temporary lot at a cost of $30,246.00 and removal of the pavement/grindings at lot at a later date with an allowance of $6006.00 for a total cost of $46,252.00. The City has verified this to be a reasonable cost to secure 100-150 parking places for the next three years. The Doughtery Valley Regional Enhancement Fund will reimburse the City of San Ramon for the temporary parking lot. The Village Center owners have a cost sharing agreement already in place that specifies the proportional share of maintenance for all of the shared areas in the Village Center, so the owners will amend the agreement to include shared maintenance of the temporary parking lot at the same proportional share. Maintenance is expected to be minimal and will be provided by the City.
