(7505-6F8229) FISCAL IMPACT: No impact to the General Fund. Costs to participate in the Bay Area Integrated Regional Water Management Plan (IRWMP) will be funded through Flood Control District funds. Flood Control District projects will benefit from inclusion in the IRWMP by being appropriately prioritized and eligible for grant funding from the State requiring integrated water resource planning. BACKGROUND: The Board approved the Bay Area Integrated Regional Water Management Plan (IRWMP) on November 13, 2006. The IRWMP is comprised of four water resource service areas: Water Supply/Water Quality, Waste Water/Reclaimed Water, Watershed/Habitat, and Flood Protection/Stormwater. Bueren, Public Works Director/Chief Engineer Date:September 14, 2010 Contra Costa County Subject:Approve agreement entitled “Deposit and Disbursement of funds for San Francisco Bay IRWMP: Marin Municipal Water District Trust Fund” BACKGROUND: (CONT'D) The overall IRWMP process is managed by a Coordinating Committee with committee members representing each of the four service areas. The Flood Control District represents the Flood Protection/Stormwater service area. One issue that has surfaced at the IRWMP Coordinating Committee meetings is the need to fund certain activities, such as updating the website, collating project lists, adding projects to the plan, etc. On September 11, 2007, the Board approved a similar agreement with the State Coastal Conservancy, representing the Watershed/Habitat service area, as the lead agency. That agreement established a $100,000 fund made up of contributions from each of the four service areas. Each service area contributed $25,000 to establish the fund. The Coordinating Committee was then able to appropriate funds and hire a consultant, upon approval by the Committee, for various activities. Those funds have been expended and a new agreement is needed to provide additional funds. The Marin Municipal Water District represents the Water Supply/Water Quality service area and has agreed to be the fiscal agent for this current agreement. Each of the four service areas would contribute funds to the Marin Municipal Water District and they would bank the funds in a separate account and hire consultants, once approved by the IRWMP Coordinating Committee. The contributing share of the Flood Protection/Stormwater service area would be collected through the Bay Area Flood Protection Agencies Association. The Contra Costa County Flood Control District is a founding member of the Bay Area Flood Protection Agencies Association. The Contra Costa County Flood Control District’s share of the current agreement would be $3,000 - $5,000, depending on how the Association calculates the proportionate share of each Association member. The Contra Costa County Flood Control District has agreed to collect the funds for the Bay Area Flood Protection Agencies Association and provide those funds to the Marin Municipal Water District for the Flood Protection/Stormwater service area agencies responsibility pursuant to the agreement. The attached IRWMP agreement is very similar to the agreement approved by the Board on September 11, 2007. The primary difference is that the Marin Municipal Water District is the fiscal agent for the current agreement while the State Coastal Conservancy was the fiscal agent for the prior agreement. CONSEQUENCE OF NEGATIVE ACTION: The Flood Control District will not have authorization to sign the agreement, which would delay and disrupt a regional effort for water resource planning.
