APPROVE and AUTHORIZE the Chair, Board of Supervisors, or designee, to execute the
Second Amendment to Agreement No. 208 to provide right of way services by Contra
Costa County (County) to the Contra Costa Transportation Authority (CCTA) for the State
Route 4 East Widening Somersville Road to State Route 160 Project to increase the
payment limit by $1,392,900 to a new payment limit of $4,245,900, effective July 21, 2010,
and to amend the scope of work for services provided by the County to CCTA for State
Route 4 East Widening Somersville Road to State Route 160 Project, East County area.

FISCAL IMPACT:
CCTA will pay the actual costs for County Real Property staff right of way services.
BACKGROUND:
CCTA requires a variety of right of way services but has no right of way staff and has
contracted with the County for these services. On June 21, 2006 the Board approved the
original agreement No. 208 for the State Route 4 East Widening Somersville Road to State
Route 160

BACKGROUND: (CONT'D)
project for right of way acquisition services. The parties now wish to modify the scope of
services to include additional right of way acquisition services for approximately 55
parcels and increase the total payment of the Agreement.
CONSEQUENCE OF NEGATIVE ACTION:
CCTA would not be able to contract the County’s right of way services.
