APPROVE and AUTHORIZE the Director of Conservation and Development to execute an
agreement with Corinne Burt compromising permit fees for her land use project.
FISCAL IMPACT:
No General Fund impact.
BACKGROUND:
In September 2009, the County approved and issued a land use permit to Ms. Burt for the
operation of an equestrian center and stables on Ms. Burt’s property. The County charged
Ms. Burt approximately $12,900.00 in permit application and processing fees. To date, Ms.
Burt has paid $8,293.46 in permit fees.
On May 7, 2010, Ms. Burt filed a complaint for declaratory relief alleging that she was
overcharged regarding the fees for her land use permit. (Corrine Burt v. County of Contra
Costa, et al., Contra Costa Superior Court Case No. L10-03642.) Following settlement
negotiations, Conservation and Development staff and the opposing party agreed on
settlement terms, subject to approval by the

BACKGROUND: (CONT'D)
Board of Supervisors. Under the terms of the settlement agreement, Ms. Burt will pay the
County an additional $3,234.22 in land use permit fees to the County. After Ms. Burt pays
this remaining amount, the lawsuit will be dismissed with prejudice. Conservation and
Development staff recommends approval of the settlement agreement to avoid the time and
expense of continued litigation.
