APPROVE Temporary Occupancy Permit between Contra Costa County Flood Control and
Water Conservation District (District) and Burlington Northern Santa Fe Railway Company
(BNSF) for Walnut Creek levee raising at or near Station 141-Lt.
AUTHORIZE the Chief Engineer, or designee, to execute said Temporary Occupancy
Permit on behalf of the District.
APPROVE payment of $1000.00 for said property rights and $500.00 for BNSF’s
Protective Policy.
AUTHORIZE the Auditor-Controller to issue a check in the amount of $1500.00 payable to
BNSF and forward to the Real Property Division for delivery.
DIRECT the Real Property Division to have the above referenced Temporary Occupancy
Permit delivered to BNSF.

FISCAL IMPACT:
There is no impact to the County General Fund. Funding is 100% Flood Control Zone 3B
funds.
BACKGROUND:
These property rights are required for the Walnut Creek Levee Rehabilitation Project,
Sta. 141-Lt in accordance with the approved plans and specifications.
As a condition of the Temporary Occupancy Permit, BNSF has required the District to
indemnify BNSF and the indemnification language has been reviewed by County Risk
Management.
CONSEQUENCE OF NEGATIVE ACTION:
The project will not have sufficient land rights to allow construction in accordance with
the approved plans and specifications.
