ADOPT Ordinance No. 2010-05, attached hereto, establishing a per parcel annual fee in Zone 3112 (all property within the Colina Canyon Subdivision, County File #SD03-8791) in the El Sobrante area. 3. ADOPT Resolution No. 2010/418 RECOMMENDATION(S): (CONT'D) , attached hereto, authorizing an election in Zone 3112 of County Service Area P-6 to consider approval of Ordinance No. 2010-05. 4. APPROVE a one-time reduction in the established election procedure for this election. 5. DIRECT the County Clerk, Elections Division, to conduct the election required by Government Code sections 23027 and 53978. This mail ballot election shall be held on August 24, 2010. FISCAL IMPACT: The parcel tax will potentially generate $6,400 annually to augment police protection services in the zone. BACKGROUND: Establishment of the proposed police services tax district is required per the conditions of approval for the Colina Canyon Subdivision (County File #SD03-8791, Condition of approval #19). The condition of approval requires the developer to participate in an election to place the subdivision into a new police service district in order to provide additional funding to augment police services. The Colina Canyon subdivision project was approved by the Board of Supervisors on September 2, 2005. The subdivision consists of 32 new single family lots on a 3.48-acre property located on Appian Way in the El Sobrante area. The proposed zone will allow the levying of an initial annual assessment of $200 per lot. On July 27, 2010, the Board of Supervisors adopted a resolution (Resolution #2010-399) initiating the proceedings to form Zone 3112, and fixed August 10, 2010 as the hearing date on formation of the zone. The proposed zone would serve as the vehicle to collect special taxes within the zone if a special tax measure is approved by voters. Adoption of Resolution No. 2010-417 (part A of the recommended action) would form Zone 3112 of County Service Area P-6, in the El Sobrante area. Adoption of Ordinance No. 2010-05 (part B of the recommended action) would authorize the levy of a special tax for police protection services on all taxable parcels in the area of Zone 3112, if a special tax ballot measure is approved by a two-thirds majority of voters voting on the measure. Adoption of Resolution No. 2010/418 (part B of the recommended action) would establish language for the ballot measure and direct the Elections Division to conduct the election as a mail ballot election on August 24, 2010. The election period is reduced from 60-days to two weeks in order to accommodate the filing of the final map for the Colina Canyon Subdivision. CONSEQUENCE OF NEGATIVE ACTION: The developer would not be in compliance with the conditions of approval for the subdivision, which could potentially prevent the final map from being recorded. CHILDREN'S IMPACT STATEMENT: None.
