1. CONDUCT HEARING to confirm the Fiscal Year 2010/2011 Annual Report for County
Service Area M-28.
2. ADOPT Resolution No. 2010/406 confirming the Fiscal Year 2010/2011 Annual Report
for Contra Costa County Service Area M-28, to levy and collect annual water service
charges on the Fiscal Year 2010/2011 property tax roll.
FISCAL IMPACT:
There is no fiscal impact to the County General Fund. All costs will be covered with
revenue from CSA M-28.
BACKGROUND:
The proposed annual levy of water service charges benefits all property owners within
County Service Area M-28 (Willow Mobile Home Park Water District) by providing for a
community water system (miscellaneous extended service) in accordance with Government
Code Section 25210.4(d). The County Service Area M-28 (Willow Mobile

BACKGROUND: (CONT'D)
Home Park Water District) (miscellaneous extended service) includes, but is not limited
to, the acquisition, construction, operation, replacement, maintenance, and repair of water
supply and distribution systems, including land, easements, rights-of-way, and water
rights [Government Code Sections 25210.4(a)(1)].
On June 22, 2010, the Board of Supervisors adopted Resolution No. 2010/355 accepting
the filing of the Annual Report for County Service Area M-28 for Fiscal Year 2010/2011
(shown as Exhibit A), declaring the intention to levy the proposed water annual service
charge, and fixing August 10, 2010 at 10:00 a.m. in the Board Chambers, as the time and
place for a public hearing.
On June 22, 2010, the maximum annual charge rate for CSA M-28 was proposed to be
increased from $82,156 to $95,500 per parcel with an allowance for future increases
based upon the prior year’s change in the Consumer Price Index for the San Francisco
Bay Area – All Urban Consumers. In order to impose the increase, California State
Proposition 218 requires a majority approval of the property owners. On June 23, 2010, a
notice and ballot was mailed to the property owner regarding the increase in the charge
which allowed the opportunity to vote. Since this time, the property owner has notified
County staff that he would not support the increase, and therefore no ballots will be
tabulated at the public hearing.
The attached resolution will fix the Fiscal Year 2010/2011 charge rate at $83,628.03 per
parcel. This rate is a 1.79% increase over the Fiscal Year 2009/2010 charge rate. This
increase is based upon the prior year’s change in the Consumer Price Index for the San
Francisco Bay Area – All Urban Consumers, which is within the current allowable
maximum rate that was set in Fiscal Year 2007/2008.
CONSEQUENCE OF NEGATIVE ACTION:
The District would be unable to have the Fiscal Year 2010/2011 water service charges
collected by the County Tax Collector, and an alternate source of funding would have to
be identified.
