Approve and authorize the Health Services Director, or his designee, to issue a thirty (30)
day advance written notice to David H.C. Raphael, M.D., to terminate Contract #26-938-11
(as amended by Amendment Agreement #26-938-12) for provision of general surgery
services for patients at Contra Costa Regional Medical Center and Contra Costa Health
Centers, effective close of business on November 3, 2010.
FISCAL IMPACT:
This Contract was funded by Enterprise Fund I.
BACKGROUND:
On May 5, 2009, the Board of Supervisors approved Contract #26-938-11 (as amended by
Amendment Agreement #26-938-12) with David H.C. Raphael, M.D., in an amount not to
exceed $600,000, for provision of general surgery services, including consultation, clinic
coverage, training, medical and/or surgical procedures, and on-call coverage for patients at

BACKGROUND: (CONT'D)
Medical Center and Contra Costa Health Centers, for the period from June 1, 2009 through
May 31, 2011.
Approval by the Board of Supervisors will allow the Health Services Department to issue a
thirty (30) day advance written notice to the Contractor, in accordance with Contract
#26-938-11, Paragraph 5. (Termination and Cancellation) of the General Conditions that the
Contract is terminated effective close of business on November 3, 2010. A new contract
may be negotiated with this surgeon or a replacement surgeon reflecting the service needs
of Contra Costa Regional Medical Center.
