HomeMy WebLinkAboutMINUTES - 08032010 - C.01RECOMMENDATION(S): APPROVE and AUTHORIZE the Public Works Director, or designee, to execute Amendment No. 3 to an existing Consulting Services Agreement with Nolte Associates, Incorporated effective August 5, 2008, to increase the current payment limit by $200,000 to a new payment limit of $3,088,500, in order to complete construction support on the Vasco Road Safety Improvements Project Phase 1, Brentwood, Byron area. (Project No. 0662-6R4254) FISCAL IMPACT: There is no fiscal impact to the General Fund. This Consulting Services Agreement Amendment allows for an additional $200,000 above the previously approved contract payment limit of $2,888,500. The increase in payment is to be funded by Road funds (100%). BACKGROUND: On August 5, 2008, the Board of Supervisors approved the Consulting Services Agreement (CSA) for final civil engineering design and construction support services for the Vasco Road Safety Improvements project with Nolte Associates, Incorporated. Project No. 0662-6R4254 proposed BACKGROUND: (CONT'D) to construct a permanent concrete median barrier along a 2.3 mile stretch of Vasco Road beginning approximately 3 miles north of the Alameda County line to approximately 5.3 miles north of the County line. Since then, County staff has identified construction funding sources for a 1.2 mile stretch of the project and has split the project into two phases. The first phase is fully funded and includes $11,700,000 of American Reinvestment and Recovery Act (ARRA) funds. Phase 1 is currently under construction and the construction contract was awarded March 23, 2010. Nolte Associates, Incorporated is the designer of the Vasco Safety Improvements Project – Phase 1 and has provided the County with final plans, specifications, and estimate for the project. During the construction phase of the project, Nolte Associates, Incorporated will provide construction support services. The proposed amendment will amend payment limits and allow for additional payment toward continuing construction support services, as described in the Agreement and previous amendments. This amendment is needed due to unanticipated project conditions. CONSEQUENCE OF NEGATIVE ACTION: If the amendment is not approved, Nolte Associates, Incorporated cannot be paid for the additional required work and the construction of the project may be delayed.
