THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on February 5, 1985 , by the following vote:
AYES: Suppervisors Powers , Schroder , McPeak, Torlakson and
Fanden
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Hearing on appeal of Delta Associates , (Applicant and
Owner) from conditions imposed by the Zoning_.
Administrator and Board of Appeals on LUP No. 2121-82,
Bethel Island area.
The Board on January 15, 1985 continued its hearing on the
above matter to this date and time, and directed staff to clarify
the issues of the original 1982 Land Use Permit , and to submit a
report to the Board thereon.
Harvey Bragdon, Assistant Director of Planning, submitted a
written report , and reviwed the status of compliance with the
various conditions that were imposed in the 1982 Land Use Permit , :
and advised that the Planning Department staff recommends denial
of the appeal (request to delete eonditons) .
Supervisor Torlakson commented on the unmet conditions and
inquired as to the deadline recommended by staff for meeting those
conditions .
Mr . Bragdon advised that , in his opinion, the applicant should
be able to comply with the unmet conditions within the next thirty
(30) days .
Supervisor Torlakson suggested that language be added to the
conditions of the Land Use Permit to include full compliance with
Sanitation District N o. . 15 requirements , including upgrading of
the small lift stations , and full compliance with Building
Inspection' s electrical and other requirements , within thirty (30)
days , and not operating the deli until there is approval .
Mr . Bragdon advised that the applicant had agreed not to
reopen the deli until the matter of the revocation hearing is
settled and until he had gone through Development Plan approval .
Mr . Bragdon stated that approval had been withheld pending sched-
uling of the revocation hearing.
Supervisor Torlakson suggested that operation of the deli
prior to issuance of a permit by the Health Department would be
grounds for revocation of the Land Use Permit .
Supervisor Torlakson then discussed the school fee, as well as
the number of units (recreational vehicles ) occupied and which

units were considered permanent at this time, and advised that ,
based on the information provided of seven (7) school-age children
in the Park, he would accept a school fee of $360 for each space
in the park, and that he concurs with the Planning Department' s
recommendation - to deny the applicant' s request to delete eon-
ditions imposed by the Planning Commission.
Based upon the testimony, reports and other doeuments sub--
mitted, IT IS BY THE BOARD ORDERED that the request of Delta
Associates to delete conditions imposed by the Zoning
Administrator and the Board of Appeals (Planning Commission) is
DENIED, and the Planning Commission' s decision is AFFIRMED with
modifications , and the conditions , as set forth in Exhibit A,
attached hereto and by reference incorporated herein, are imposed
or reaffirmed, as the case may be .

SUBJECT: Review Policy on L.U.P. revocation hearings and
enforcement
Supervisor Torlakson commented that he was of the opinion that
when there has been need for repeated hearings on compliance with
conditions imposed pursuant to land use permits , and the permittee
has repeatedly missed deadlines , the revocation hearing should be
heard immediately by the Board of Supervisors without the need for
hearings before the Zoning Administrator and Board of Appeals
before the matter may be appealed to the Board.
As recommended by Supervisor Torlakson, IT IS ORDERED that
County Counsel and the County Administrator are REQUESTED to
review the County' s enforcement policy on Land Use Permits and
revocation hearings , and to submit their recommendations to the
Board.
