ADOPT Ordinance No. 2010-08 extending the Montalvin Manor Building Permit Amnesty
Program to December 31, 2010.
FISCAL IMPACT:
No impact on the General Fund. Costs of preparing the Montalvin Manor Building Permit
Amnesty Program have been paid by Montalvin Manor Redevelopment Funds.
Implementation of the Montalvin Manor Building Permit Amnesty Program will be covered
by application fees.
BACKGROUND:
On June 23, 2009, the Board of Supervisors adopted Ordinance No. 2009-21 (Exhibiit A),
which established the Montalvin Manor building permit amnesty program (Amnesty
Program). The Amnesty Program addresses previous building activities to single-family
homes that have taken place without obtaining proper County permits, while exempting
applications to legalize specified unpermitted construction from late fees and penalities
during a one year-period. The amnesty period established by Ordinance No. 2009-21 ends
on July 23, 2010.

BACKGROUND: (CONT'D)
During the last 11 months of the amnesty period, staff has outreached to the community,
via mass mailings to property owners and having technical assistance meetings in the
community, to encourage participation in the Amnesty Program. During the amnesty
period, staff has seen 60 property owners interested in applying for a building permit
under the Amnesty Program. Of the 60 property owners, 35 have submitted applications
under the Amnesty Program, with 24 of those receiving their building permits. Of those
who have received a building permit, 11 have been officially signed off and finalized
with their final inspection.
Staff recommends extending the Amnesty Program to December 31, 2010 to allow an
additional opportunity for property owners of single-family residential units in Montalvin
Manor to apply for a building permit under the Amnesty Program. Extending the
Amnesty Program will allow property owners who have not applied under the Amnesty
Program to prepare their necessary plans to apply for a building permit and organize their
finances to pay for the permit fees associated with a building permit. A copy of the
proposed ordinance extending the Amensty Program is attached for review (Exhibit B).
This ordinance continues the Amnesty Program that began under Ordinance No. 2009-21,
and provides that the Amensty Program ends on December 31, 2010.
