APPROVE and AUTHORIZE the Chief Engineer, Flood Control and Water Conservation
District, or designee, on behalf of the Contra Costa Clean Water Program, to execute a
contract with Brown and Caldwell in the amount not to exceed $140,000 for Technical and
Project Management Support Services for the period July 1, 2010 through June 30, 2011,
Countywide. (100% Cities and County Stormwater Utility Fee Assessments) Project No.
7519 6x7616
FISCAL IMPACT:
100% Stormwater Utility Fees.
BACKGROUND:
The United States Environmental Protection Agency issued the National Pollutant
Discharge Elimination System (NPDES) Regulations for municipal stormwater discharges
on November 16, 1990 requiring Contra Costa County, nineteen (19) of its incorporated
cities and the District to obtain Joint Municipal NPDES permits (Permit) from the San
Francisco Bay and Central Valley Regional Water Quality Control Boards Water Board(s)).
The permits require municipalities to radically reduce or eliminate all pollutants from

BACKGROUND: (CONT'D)
The Contra Costa Clean Water Program (Program) is made up of representatives of each
of the nineteen (19) cities, the County, and the Flood Control District. One representative
of each municipality participates on the Management Committee, the Program's decision
making body. The Management Committee has directed that important requirements of
the Permit, such as stormwater monitoring, conducting special studies and watershed
assessments, be performed by the Program. Technical and project management services
provided by Brown and Caldwell are required to keep the Program in compliance.
CONSEQUENCE OF NEGATIVE ACTION:
If the contract with Brown and Caldwell is not approved, then all municipalities may be
in non-compliance with the Permit(s) issued by the Water Boards. Potentially, fines
totaling $10,000 per day and $10 per gallon of stormwater discharged for all affected
entities could be imposed.
