Authorize the Chair of the Board of Supervisors to sign a letter transmitting comments to
the Liberty Union High School District on the District's Final Environmental Impact Report
on the Fourth High School.
FISCAL IMPACT:
None.
BACKGROUND:
The Liberty Union High School District (LUHSD) is preparing to certify a Final
Environmental Impact Report (FEIR) for a proposed fourth high school at the southwest
corner of the intersection of Delta Road & Sellers Road in unincorporated east Contra Costa
County.
During the course of environmental review, staff from Contra Costa County and the cities of
Brentwood and Oakley submitted comments expressing substantial concern about the
impacts of the project. Comments have included concern about the remote location of the
site (which LUHSUD preliminarily indicates will not be mitigated), and the lack of safe

V offices arranged for city and County representatives to jointly approach LUHSD and
communicate our concerns on the project. Staff from the cities and the County, in
addition to District III and District V offices have been meeting periodically over the past
four months to come to resolution on mitigations.
Staff is unsure of the timing of the release of the FEIR. Due to the limited ten-day review
time frame afforded an FEIR under the California Environmental Quality Act, staff is
seeking prior authorization to have the Chair of the Board of Supervisors sign a letter on
the document in order to ensure the County will submit a letter within the comment
period. The letter will be developed in consultation with the District III and District V
offices and consistent with the results of the aforementioned meetings and with prior
comments submitted to the lead agency. The City of Brentwood has submitted a similar
letter (attached).
