SUBJECT: Mandatory Solid Waste Subscription Ordinance
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Introduce, waive reading, and fix Tuesday, February 12, 1985 for adoption of
attached ordinance calling for mandatory solid waste subscription in the un-
incorporated area of the county presently served by a collection company.
2. Direct the County Administrator to forward the attached ordinance to the County
Solid Waste Commission with the request that the Commission forward it to those
cities and sanitary districts which do not have a mandatory solid waste sub-
scription ordinance with the suggestion that such cities and sanitary districts
consider adoption of the County's ordinance or one similar to it.
3. Direct the Health Services Director to return to the Board by March 12, 1985 with
a proposed policy for implementation of the ordinance so the Board may review
and approve such policy prior to the effective date of the ordinance.
4. Request the Executive Director, Contra Costa County Housing Authority, to advise
the Board of Supervisors of the Authority's current policy regarding the payment
for and availability of garbage service in the Authority's projects throughout
the County.
BACKGROUND:
Our Committee has had on referral for some time a recommendation from the Solid Waste
Commission that the Board enact a mandatory solid waste collection ordinance in the
unincorporated area of the County. Our Committee has considered a number of alternatives
and has had extensive discussions with staff from the Health Services Department,
Public Works Department and County Counsel .
A number- of cities and two sanitary districts in the County presently have mandatory
subscription ordinances. These ordinances are intended to require that every house-
hold subscribe to the available garbage collection service which is franchised for
their area in an effort to insure that all garbage is collected regularly. However,
substantial unincorporated areas of the County do not have such a mandatory sub-
scription requirement. As a result, in some areas of the County, there is a very
real problem with the accumulation of garbage, even though the area is served by a
franchised garbage collection company. This ordinance will require, with specified
exceptions, that every household in the unincorporated area of the County subscribe
to the available garbage collection service. The ordinance will not apply within cities
nor within those relatively few areas of the County which have no garbage service
available.

In addition, it is our intent that the ordinance be used selectively as
a tool to deal with specific problems which are causing a public health hazard.
As a result, we are recommending that the Health Services Director be directed
to outline the policy he intends to follow in implementing the ordinance so the
Board can determine that such policy is consistent with the Board's intent in
this regard. Our Committee continues to be concerned about whether garbage
service is routinely provided to tenants in county housing projects and have,
therefore, requested a_report from the Housing Authority on this issue. .
