ADOPT Resolution No. 2010/380 APPROVING and AUTHORIZING the submittal of a
regional application designating the Contra Costa Clean Water Program as lead agency on
behalf of annually consenting co-permittees participating in the Used Oil Payment Program
(OPP), effective July 1, 2010.
FISCAL IMPACT:
There is no fiscal impact. The Contra Costa Clean Water Program is funded by the
municipalities.
BACKGROUND:
The United States Environmental Protection Agency issued the National Pollutant
Discharge Elimination System (NPDES) Regulations for municipal stormwater discharges
on December 1, 2009, requiring Contra Costa County, nineteen (19) of its incorporated
cities and the Contra Costa County Flood Control and Water Conservation District to be
regulated under a Joint Municipal NPDES permit from the San Francisco Bay. The Central
Valley Regional Water Quality Control Board NPDES Permit will soon be promulgated.
The Permits require municipalities to radically reduce or eliminate

On June 26, 2007 Resolution 2007/34 was passed by the Board of Supervisors
authorizing the submittal of regional applications on behalf of specified municipalities for
five fiscal years under the California Integrated Waste Management Authority's Used Oil
Block Grant UOBG). Effective July 1, 2010, the UOBG grant program was renamed the
Used Oil Payment Program (OPP) and moved to CalRecycle for its administration. The
OPP allows municipalities to designate a lead agency to administer grant funds in
perpetuity on their behalf, provided municipalities re-designate the lead agency with each
fiscal year grant application. A new resolution is required to continue the grant funding
which promotes the recycling of used motor oil, a significant pollutant in stormwater.
This program is a long-term commitment to modify social behavior to reduce pollution to
the San Francisco Bay/San Joaquin Delta.
The recommendation of the Contra Costa Clean Water Program is to approve the
resolution authorizing submittal of a regional application for specified municipalities (see
attached OPP Resolution and municipal co-permittee's designation letters).
