ADOPT Resolution No. 2010/05 accepting tabulation of mail-in ballots, considering any
objections, confirming assessment, and authorizing the levy and collection of the
assessment for the annexed territory of the Colina Canyon subdivision to the Hillcrest
Heights Geologic Hazard Abatement District (“GHAD”).
FISCAL IMPACT:
There is no impact to the County General Fund. All costs will be covered with revenue
generated through parcel assessments on the properties within the Hillcrest Heights GHAD.
BACKGROUND:
Due to the potential for landsliding, erosion, and required ongoing maintenance, the
Conditions of Approval for the Colina Canyon development (Subdivision 8791) require that
the Colina Canyon subdivision be included within a GHAD prior to the submission of a
final map for

the project. To satisfy this requirement, the developer of the Colina Canyon subdivision
elected to petition the GHAD Board to annex the Colina Canyon subdivision into the
existing Hillcrest Heights GHAD. The territory to be annexed pursuant to the Resolution
No. 2010/03 is currently owned by the developer. The boundaries of the territory to be
annexed and the boundaries of the Colina Canyon subdivision are the same.
On April 20, 2010, the GHAD Board accepted Resolution No. 2010/01 accepting a
Petition requesting annexation and set a hearing for May 11, 2010 to annex the Colina
Canyon subdivision into the Hillcrest Heights GHAD.
On May 11, 2010, the GHAD Board adopted Resolution No. 2010/03 approving the
annexation and plan of control and Resolution No. 2010-04 declaring its intent to order
an assessment on the newly annexed area and directed a hearing for July 13, 2010 to
consider the proposed assessment.
Funding for the GHAD activity on the territory proposed to be annexed is based on an
assessment from each residential lot in the Colina Canyon subdivision, and such funding
will be collected and used in connection with the Colina Canyon Plan of Control. The
proposed assessment of $1105 for each of the 32 detached single residential units in the
subdivision is supported by a detailed Engineer’s Report prepared by a registered
professional engineer certified by the State of California, and is attached to Resolution
No. 2010/04. The proposed assessment does not impact or change the existing
assessments for the current landowners in the GHAD.
If imposed by the GHAD Board of Directors on July 13, 2010, the annexed territory will
be subject to an assessment of $1,105.00 per year with an adjustment annually to reflect
the percentage change in the San Francisco-Oakland-San Jose Consumers Price Index for
All Urban Consumers, which shall be levied on each parcel the first fiscal year following
recordation of the final map for the Colina Canyon development. The assessment will
continue to be levied in perpetuity.
In accordance with the requirements of Article XIII(D) of the California Constitution and
Public Resources Code sections 26650 et seq., the GHAD clerk mailed, by first class
mail, the “Notice of Adoption of Resolution” to each owner of real property (as shown on
the last equalized property tax roll of the County) that was annexed to the Hillcrest
Heights GHAD on May 11, 2010 (and approved by the Board of Supervisors on May 18,
2010), as shown on the Boundary Map (Exhibit A to the Engineer’s Report). The
sealable Ballot and the Engineer’s Report were attached to the Notice of Adoption of
Resolution.
At the July 13, 2010 hearing, the GHAD Board shall accept the ballots, consider any
objections, direct the GHAD Clerk/Attorney to open and tabulate the ballots, and if
sufficient votes on the ballots occur, confirm and authorize the levy and collection of the
assessments.
CONSEQUENCE OF NEGATIVE ACTION:
The Board of Supervisors required the approval of the proposed assessment as a
condition of approval for annexation of the Colina Canyon subdivision into the Hillcrest
Heights GHAD. If the GHAD Board does not proceed with this matter, the annexation
will not occur.
