DETERMINE that this termination of an Offer of Dedication for a storm drain easement is
no longer required for drainage purposes, is made pursuant to Government Code Section
66477.2 (c) shown delineated on Lots 1, 2, 4-9, and 18 adjacent to Miranda Court, in
Subdivision 7898, filed August 9, 1995 in Book 381 of Parcel Maps, page 33 and to
Division 9, Part 3, Chapter 4 of the Streets and Highways Code, commencing with Section
8330, et. seq. A description of the offered area to be terminated is attached hereto as Exhibit
"A" and incorporated herein by reference located in the Alamo area.
DETERMINE that this termination request is for a storm drain easement that has not been
used for the purposes for which it was dedicated. (S&H Code Section 8333(a)).
FIND there is no reasonable probability that Contra Costa County (County), or its designee,
will accept the public service easement into the County drainage system, that no public
money has been expended for maintenance of the offered storm drainage easement and that
it is in the best interest of the County, or its designee, and the public that the offered area be
privately owned and maintained.

DETERMINE
RECOMMENDATION(S): (CONT'D)
that the proposed termination of an offer of dedication will not have a significant effect
on the environment, and that it has been determined to be exempt from the California
Environmental Quality Act (CEQA) under State CEQA guidelines pursuant to Article 5,
Section 15061 (b)(3), and DIRECT the Director of Department of Conservation and
Development (DCD) to file a Notice of Exemption with the County Clerk, and DIRECT
the Public Works Director to arrange for payment of a $50.00 fee to the County Clerk for
filing and $25.00 fee to DCD for processing the Notice of Exemption.
DECLARE that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached
Exhibit “A”. From and after the date this Board Order is recorded, the area vacated no
longer constitutes a public service easement.
DIRECT the Real Property Division to record a certified copy of this Board Order in the
Office of the County Recorder.
FISCAL IMPACT:
There is no impact to the County General Fund.
BACKGROUND:
Contra Costa County Flood Control and Water Conservation District no longer requires
the drainage easement for drainage purposes for Miranda Creek. The excess portion of
drainage areas are [approximately 40 ft. wide by 1,178 ft long (Lots 1, 2, 4 through 9,
and 18), (APNs 193-070-028, 029, 031, 032, 033, 034, 035, 036, and 045), Lot 3 (APN
193-070-030) was previously terminated].
CONSEQUENCE OF NEGATIVE ACTION:
The County would encumber and may be responsible for maintenance to an area that is
no longer needed for drainage purposes.
