HomeMy WebLinkAboutMINUTES - 06222010 - C.06RECOMMENDATION(S): APPROVE and AUTHORIZE the Redevelopment Agency Director, or designee, to execute the Amendment to the 1986 Grant of Easement between Contra Costa County Redevelopment Agency (Agency) and Central Contra Costa Sanitary District (District), which changes the legal description to the Grant of Easement dated May 30, 1986; and DIRECT the Agency to have the above referenced Amendment to 1986 Grant of Easement forwarded to the District for acceptance and recording in the Office of the County Recorder. FISCAL IMPACT: There is no impact to the County General fund. BACKGROUND: In 1986, the Agency purchased portions of the Iron Horse Corridor (IHC) from Southern Pacific Railroad (SPRR) with monetary help from the District. Project No. 0678-6G5575 BACKGROUND: (CONT'D) lease agreements with SPRR. The Grant of Easement was granted to the District on May 30, 1986 and recorded on May 30, 1986 in Book 12911 of the Official Records of the Contra Costa County at page 849 (12911OR849) which states that the location of the easement area specified therein was based on the best information available at the time of execution, and allows the parties to amend the easements upon determination of a more precise location of existing or proposed facilities. The District has now determined and mapped the precise location of their facility and would now like to amend the legal description and plat of the original 1986 Grant of Easement, 12911OR849. All other terms and conditions of the original grant of easement will remain in full force and effect. In December of 1986, the Board of Supervisors determined that the sale of easements to Central Contra Sanitary District was exempt from the California Environmental Quality Act under State Guidelines, Section 15112. CONSEQUENCE OF NEGATIVE ACTION: The legal description and plat will not be correct. CHILDREN'S IMPACT STATEMENT: ATTACHMENTS Attachments
