SHARP , Deputy RECOMMENDATION(S): APPROVE the Right of Way Contract and month-to-month Rental Agreement, dated June 7, 2010, and ACCEPT the Grant Deed from Angela Cruse, Trustee of the Cruse Revocable Trust of February 27, 2005, for 30 Drake Street, Antioch, Assessor’s Parcel No. 067-283-011. AUTHORIZE the Public Works Director, or designee, to execute said Right of Way Contract and Rental Agreement on behalf of Contra Costa County (County). RECOMMENDATION(S): (CONT'D) APPROVE payment of $233,000 property rights payable by the Contra Costa Transportation Authority (CCTA) to North American Title Company, through wire instructions to: Comerica Bank Escrow Account, 2321 Rosecrans Ave., Ste. 5000, El Segundo, CA 90245; Federal Routing No. 121137522; Credit Account No. 1893547057; County and Branch No.: 54705; Attention: Cathy Coghlan, phone (925) 838-4899 for Escrow No. 827236-08. DIRECT the Real Property Division to have the above referenced Rental Agreement delivered to Angela Cruse, Trustee and ensure the Grant Deed is delivered to the Title Company for recording in the Office of the County Recorder. FISCAL IMPACT: There is no impact to the County General Fund. These activities are funded by Contra Costa Transportation Authority (100%) (ACQ/3540). BACKGROUND: These property rights are required for the State Route 4 (E) Widening – Somersville Rd. to Route 160 Project in accordance with the approved plans and specifications. The County agreed to enter into a Rental Agreement which will allow the tenant to remain on the property while in the progress of finding a replacement dwelling. CONSEQUENCE OF NEGATIVE ACTION: The project will not have sufficient land rights to allow construction in accordance with the approved plans and specifications and the tenants will not have the rights to occupy the property.
