APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a
Memorandum of Understanding with the State Route 4 Bypass Authority that outlines the
roles and responsibilities for the construction and use of federal stimulus American
Recovery and Reinvestment Act (ARRA) funds for the Marsh Creek Road RAC Overlay
project, Brentwood area. Project No. 4660-6X4462
FISCAL IMPACT:
There is no impact to the County General Fund. The project is funded with 85.3%
ECCRFFA funds and 14.7% Federal funding from the American Recovery and
Reinvestment Act.
BACKGROUND:
The County, on behalf of the State Route 4 Bypass Authority, has applied for federal
stimulus (ARRA) funds for the Marsh Creek Raod RAC Overlay project. (The State Route
4 Bypass Authority does not have a master agreement with Caltrans to receive federal
funds.) Caltrans has agreed to this approach but has required that the County administer the

BACKGROUND: (CONT'D)
4 Bypass Authority will pay for 100% of all costs for the project less any ARRA funds
received and will assist Public Works Department staff to administer its construction. The
MOU outlines the specific duties and responsibilities of both agencies with respect to
project construction and the disbursement of federal funds.
The project work consists of placing a 0.15 foot overlay of Rubberized Asphalt Concrete
on existing pavement, adding backing material to the existing shoulder backing to meet
the new grade within the roadway limits, and restriping using the same current lane
configuration of two 12 foot wide lanes and 10 foot wide shoulders with thermoplastic
pavement delineations as well as a soft median barrier (rumble strips). A staging area at
the northeast corner of the intersection of the Bypass Road and Marsh Creek Road that
was used during the original construction will be reused during the proposed overlay
project. Two way traffic will be maintained throughout construction and emergency
vehicle access will be allowed at all times.
CONSEQUENCE OF NEGATIVE ACTION:
The project will lose federal funding if the Memorandum of Understanding is not signed.
