APPROVE the conveyance of a Grant of Easement by Contra Costa County Flood Control
and Water Conservation District (District) to Central Contra Costa Sanitary District
(CCCSD) for the use of a portion of the District’s Right of Way in Walnut Creek Flood
Control Channel pursuant to Government Code Section 25526.6, as recommended by the
Chief Engineer.
DETERMINE that the conveyance of said easement is in the public interest and will not
substantially conflict or interfere with the District’s use of the property.
AUTHORIZE the Chair, Board of Supervisors to execute the Grant of Easement on behalf
of the District.
DIRECT the Real Property Division of the Public Works Department to cause said Grant of
Easement to be delivered to the grantee for recording.
ADOPT the previously certified CCCSD Mitigated Negative Declaration and Mitigation
Monitoring Program (Wet Weather Bypass Project) for the purpose of conducting real

custodian of which is the Department of Conservation & Development (DCD)
RECOMMENDATION(S): (CONT'D)
Director located at 651 Pine Street, Martinez, CA), and
DIRECT the Director of DCD to file a Notice of Determination, and
AUTHORIZE the Chief Engineer to arrange for payment of a $25 fee to DCD for
processing, and a $50 fee to the County Clerk for filing the Notice of Determination.
FISCAL IMPACT:
There is no fiscal impact to the County’s General Fund. CCCSD is paying the entire
District’s cost in processing the Grant of Easement.
BACKGROUND:
CCCSD requested an easement from the District for use of a portion of Walnut Creek
Channel for the construction of a reinforced box culvert structure as part of their Wet
Weather Bypass Improvement Project. CCCSD’s box culvert will be used for the
discharge of wet weather and other treated flows from their Treatment Plant located off
Imhoff Drive in Martinez into the Walnut Creek Channel.
CONSEQUENCE OF NEGATIVE ACTION:
CCSD will not have the property rights they need for their Wet Weather Bypass
Improvement Project.
