DETERMINE that this summary vacation of a portion of a public service easement no
longer required for access/drainage purposes is made pursuant to Section 31 of the Contra
Costa County Flood Control and Water Conservation District (CCCF&WCD). A
description of the area to be vacated is attached hereto as Exhibit "A" and incorporated
herein by reference located in the Concord area.
DETERMINE that this vacation request is for an easement that has been superseded by
relocation and there are no other public facilities located within the easement. (S&H Code
Section 8333(c))
DETERMINE that the proposed vacation request is part of a larger project for which a
negative declaration covering CEQA requirements was processed by the City of Concord
and adopted by the County Board of Supervisors on April 27, 2010.
DECLARE that the hereinabove described proposed vacation area is HEREBY ORDERED
VACATED subject to any reservation and exception described in attached Exhibit "A".
From and after the date this Board Order is recorded, the area vacated no longer constitutes

RECOMMENDATION(S): (CONT'D)
DIRECT the Real Property Division to record a certified copy of this Board Order in the
office of the County Recorder.
FISCAL IMPACT:
There is no impact to the County’s General Fund.
BACKGROUND:
On April 27, 2010, the County Board of Supervisors adopted the previously certified
City of Concord Negative Declaration and accepted a Grant of Easement from Baywood
Land Management Company for ingress and egress purposes in exchange for a Quitclaim
Deed from the CCCF&WCD covering a portion of an access/drainage easement no
longer needed for flood control purposes across Assessor’s Parcel Number 126-210-045
located in Concord in connection to Galindo Creek.
CONSEQUENCE OF NEGATIVE ACTION:
The District would encumber and be responsible for maintenance to an area that is no
longer needed for flood control purposes.
