FISCAL IMPACT: No Fiscal Impact. BACKGROUND: On March 30, 2010, the Office of the Sheriff and the Deputy Sheriff’s Association discussed an error that was discovered in how the Office of the Sheriff compensated certain lieutenants for personal holiday credit. According to the Memorandum of Understanding between Contra Costa County and the Deputy Sheriff’s Association Management Unit Section 8.2, Floating Holidays, all employees will receive two (2) hours of personal holiday credit per month. It was discovered that lieutenants assigned to the Officer of the Day Program, MOTCO, and Blackhawk were not receiving the two (2) hours per month. Instead, they were erroneously paid holiday overtime or holiday compensatory time for working Lincoln’s Birthday, Admission’s Day, and Columbus Day. The Office of the Sheriff and the Deputy Sheriff’s Association agreed to waive the six month retroactive period because of the complication caused by the retirement of two effect employees and the complexity and difficulty in determining the overpayments or underpayments.
