APPROVE and AUTHORIZE the Office of the Sheriff to enforce Section 8.2 of the
Memorandum of Understanding between Contra Costa County and the Deputy Sheriff’s
Association Management Unit effective April 1, 2010, with no retroactive repayment.
FISCAL IMPACT:
No Fiscal Impact.
BACKGROUND:
On March 30, 2010, the Office of the Sheriff and the Deputy Sheriff’s Association
discussed an error that was discovered in how the Office of the Sheriff compensated certain
lieutenants for personal holiday credit. According to the Memorandum of Understanding
between Contra Costa County and the Deputy Sheriff’s Association Management Unit
Section 8.2, Floating Holidays, all employees will receive two (2) hours of personal holiday
credit per month. It was discovered that lieutenants assigned to the Officer of the Day
Program, MOTCO, and Blackhawk were not receiving the two (2) hours per month.
Instead, they were erroneously paid holiday overtime or holiday compensatory time for
working Lincoln’s Birthday, Admission’s Day, and Columbus Day.

BACKGROUND: (CONT'D)
Section 25 of the same M.O.U. directs that pay errors shall be corrected as soon as
possible but that no recovery of either overpayment or underpayments to an employee
shall be made retroactively except for the six (6) month period immediately preceding
discovery of the pay error. The Office of the Sheriff and the Deputy Sheriff’s Association
agreed to waive the six month retroactive period because of the complication caused by
the retirement of two effect employees and the complexity and difficulty in determining
the overpayments or underpayments. Additionally, there will be a cost savings associated
with enforcement of this M.O.U. section.
