HomeMy WebLinkAboutMINUTES - 05182010 - SD.3RECOMMENDATION(S): ADOPT Resolution No. 2010/255 approving a side letter to the Memorandum of Understanding (MOU) between Contra Costa County and the Deputy Sheriff’s Association Rank and File to include additional language in Section 10.2 (e)(5) exempting Deputy Sheriffs assigned to Alamo, Blackhawk, Diablo, or Roundhill from mandatory rotation. FISCAL IMPACT: No fiscal impact. BACKGROUND: On July 29, 2009, the Office of the Sheriff and the Deputy Sheriff’s Association discussed the need to align MOU language with current practice relating to the mandatory transfer of deputy sheriffs into a detention assignment. The DSA Rank and File MOU Section 10.2 (e)(5), Detention Division Transfer Policy, lists deputy sheriff assignments that are exempt from the mandatory rotation requirement. This side letter adds deputy sheriffs assigned to the police service districts of Alamo, Blackhawk, Diablo, or Roundhill as exempt from mandatory transfer during the first four (4) years of the assignment. In the meantime, agreements under the old MOU are still in effect and any changes must be agreed to by meet and confer. The Board of Supervisors adopted a policy that requires all MOU language changes to be brought before the Board for their approval. Additionally, the modified version of Section 10.2(e)(5) set forth in the side letter will be incorporated into the next MOU between the County and the DSA Rank and File Unit. Whereas, the Board of Supervisors approved the side letter between Contra Costa County and the Deputy Sheriff’s Association. The Memorandum of Understanding between Contra Costa County and the Deputy Sheriff’s Association Rank and File expired on June 30, 2008; however, agreements under the expired MOU are still being honored. Additional language has been included in Section 10.2(e)(5), Detention Division Transfer Policy, to reflect the current mandatory transfer exemption for deputy sheriffs assigned to police services districts. Now, Therefore, Be It Resolved that the Board of Supervisors of Contra Costa County APPROVE the side letter between Contra Costa County and the Deputy Sheriff’s Association, Rank and File Unit.
