DECLINE authorization of a General Plan Amendment study for Assessor Parcel Nos.
335-060-002/003/005, located at 2294 Vista Del Rio, Crockett area, to consider a change in
the General Plan land use designation from Agricultural Lands (AL) to Light Industry (LI).

None.
BACKGROUND:
The Department of Conservation and Development is in receipt of a request from Mr.
Martin E. Lysons, Gagen McCoy, on behalf of property owner for a General Plan
Amendment study involving Assessor Parcel Nos. 3555-060-002/003/005, located at 2294
Vista Del Rio in the Crockett area. The subject site is designated Agricultural Lands (AL)
under the Land Use Element Map to the Contra Costa County General Plan, 2005-2020, it is
zoned LI: Light Industry District, and it is located entirely within the Urban Limit Line. The
owner of this property, doing business as Carquinez Rock and Gravel, is seeking
authorization to consider re-designating the approximately 5-acre to

BACKGROUND: (CONT'D)
the Light Industry (LI) land use designation in support of a proposal for the building
material recycling operation (rock crushing) and continuation of a contractor yard (with a
defined length of term of operation). See Exhibit “A” for a copy of letter from Mr.
Lysons, Gagen McCoy, requesting the General Plan Amendment study authorization on
behalf of the property owner for the subject site.
The site location, comprised of Assessor Parcel Nos. 335-060-002/003/005, the subject of
the General Plan Amendment study authorization request, is depicted in the maps and
aerial photo, respectively, attached as Exhibits “B” and “C” to this report.
There has been a history of violation of the General Plan and Zoning Ordinance Code
violations for the property at 2294 Vista Del Rio associated with the improper operation
of contractor yard and a building material recycling operation. Most recently a Notice to
Comply letter was issued by the County to the property owner on April 5, 2010, followed
by a Notice of Violation letter issued by the County on April 15, 2010. See Exhibit D for
copies of both the Notice to Comply and Notice of Violation letters. Due to the repeated
violations and a number of complaints about the recycling of building materials, staff
recommends the Board decline authorization of the General Plan Amendment study at
2294 Vista Del Rio, Crockett, as requested by Mr. Lysons on behalf of his client,
Carquinez Rock and Gravel.
