ADOPT Resolution No. 2010/253, authorizing the Probation Department to charge a fee of $30.00 per day for the cost of care of a minor in detention at Orin Allen Youth Rehabilitation Facility and Juvenile Hall. FISCAL IMPACT: The total annual number of minor care days (number of days and the number of minors) at Orin Allen Youth Rehabilitation Facility (OAYRF) is approximately 36,409. Under the current fee of $17.03 per day, the Probation Department generates approximately $620,045.00 in revenue to offset a portion of the actual cost of care. The current actual cost of care per day, $31.69, exceeds the statutory maximum allowed by law. The total annual number of minor care days at Juvenile Hall is approximately 63,432. Under the current fee of $17.03 per day, the Probation Department generates approximately $1,080,247.00 in revenue to offset the actual cost of care. The current actual cost of care per day, $33.61, exceeds the statutory maximum allowed by law. Adoption of this resolution, increasing the fee to $30.00 per day, is expected to increase the estimated annual revenue to $1,902,960.00 and is necessary to offset a greater portion of the actual cost. BACKGROUND: The Welfare and Institutions Code requires a father, mother, spouse, or other person liable for the support of a minor to be responsible for the reasonable costs of support of the minor while the minor is placed, or detained, pursuant to an order of the juvenile court. (Welf. & Inst. Code section 903.) Welfare and Institutions Code section 903 requires Contra Costa County to limit “reasonable costs” to $30.00 per day. In 2003, the Board of Supervisors adopted Resolution No. 03/591, which established a fee pursuant to Welfare and Institutions Code section 903 for reimbursement of the actual cost of care of a minor in detention at OAYRF and Juvenile Hall. The Resolution authorized the Probation Department to collect $17.03 per day, per minor. In 2009, the Legislature amended Section 903, increasing the maximum allowable fee to $30.00 per day. The actual cost of care of minors at Orin Allen Youth Rehabilitation Facility increased to $31.69 per day and at Juvenile Hall, to $33.61 per day. The actual cost of providing care exceeds the statutory maximum. As such, the Probation Department must charge the statutory maximum in order to offset the actual cost as much as possible. The Probation Department’s fee survey was made available to the public at the Clerk of the Board of Supervisors at least ten (10) days before the hearing. Notice of the public hearing was published on May 1, 2010. CONSEQUENCE OF NEGATIVE ACTION: Failure to adopt Resolution No. 2010/253 will result in loss of funds to the Probation Department. The Department will not be able to collect additional fees to offset the increased costs of caring for a minor in detention at one of the County’s facilities.
