SUBJECT: Sale of easement to East Bay Nunicipal Utility District
former Southern Pacific Railroad Right of Way
Alamo-Danville Area
The Board of Supervisors of Contra Costa County RESOLVES THAT:
Contra Costa County acquired the strip of land, known as the abandoned Southern
Pacific Railroad Right of May, in the Alava-Danville area between Las Trampas Road and
Linda Nesa Avenue, from the Contra Costa County Redevelopment Agency by deed, dated
February 19, 1985. The East Bay Municipal Utility District has made an offer to
purchase an easement and temporary construction permit in the property, described in
Exhibit *A" attached hereto, for construction of an underground water pipeline.
This Board hereby FINDS that the conveyance of such an easement andtewporary
construction permit is in the public interest, and that the interest conveyed will
not substantially conflict or interfere with the use of said property by the County.
This Board hereby APPROVES and AUTHORIZES the conveyance of an easement and
teaporary construction permit in said property to East Bay Nunicipal Utility District,
pursuant to Government Code Section 25526.6 and the Board Chair is hereby AUTNMZED
to execute the attached Grant of Easement, Temporary Construction Permit and Purchase
Agreement on behalf of the County in consideration for the payment received in full in
the amount of 5690,000.00, the estimated fair (market value of the property rights
conveyed.
The Real Property Division is DIRECTED to cause the executed documents to be
delivered to the grantee.
The Board hereby FINDS that the project will not have a significant effect on
the environment, and K-MRNINES .that the project is exempt from the requirements
of the California Environmental Quality Act as a Class 12 Categorical Exemption under
County Guidelines. and Section 15312 of the State CEQA Guidelines, and DIRECTS the
Public Works Director to file a Notice of Exemption with the County Clerk. The project
has been found to conform to the General Plan of the County of Contra Costa.

The real property situated in the County of Contra Costa, State of California,
described as follows:
PARCEL ONE
A portion of the real property described in the deed from Joshua Bollinger to
Southern Pacific Railroad Company, a California corporation, recorded June 100
1891 in Book 60 of Deeds page 115, described as follows:
The strip of land 25 feet wide lyipg northeasterly of and adjoining the center
line of the parcel of land described in the above said deed from Joshua Bollinger
as a strip or tract of land 50 feet wide, lying equally on each side of the
located line of the San Ramon Branch of the Southern Pacific Railroad Company's
railroad where the same is located through the San Ramon Valley in said County of
Contra Costa and described as commencing at a point on the center line of the
said railroad where said center line intersects the northwesterly line of land of
the first party at or near survey station 725+84 of said center line and running
thence southeasterly, along said center line of said Southern Pacific Railroad
and following the curvature thereof embracing a strip of land 25 feet wide on
each side of said center line to the Southeasterly line of land of said first

Southern Pacific Railroad Company, a California corporation, recorded June 10,
1891 in Book 60 of Deeds page 100, described as follows:
The strip of land 25 feet wide lying northeasterly of and adjoining the center
line of the parcel of land described in the above said deed from August Hemme as
a strip or tract of land 50 feet wide, lying equally on each side of the located
line of the San Ramon Branch of the Southern Pacific Railroad Company's railroad
where the same is located through the San Ramon Valley in said County of Contra
Costa and described as commencing at a point on the center line of the said
railroad where said center line intersects the northwesterly line of land of said
first party at or near survey station 753+28 of said center line and running
thence Southeasterly along said center line of said Southern Pacific Railroad and
following the curvature thereof embracing a strip of land 25 feet wide on each
side of said center line to the southeasterly line of land of said first party at
or near survey station 830+42 of said center line a distance of 7714 feet, more

of the parcel of land described in the above said deed from Mary A. Van Patten as
a strip or tract of land 100 feet wide, lying equally on each side of the located
line of the Sara Ramon Branch of the Southern Pacific Railroad Company's railroad
where the same is located through the Rancho San Ramon in said County of Contra
Costa, described as commencing at' a point on the center line of said railroad
where said center line intersects the Northerly line of a private road at or near
survey station 812+00 of center line of said railroad and running thence
southerly along said center line of said Southern Pacific Railroad embracing a
