ACCEPT the Grant of Easement, dated February 26, 2010, for ingress and egress purposes
from Baywood Land Management Company, LLC in exchange for a Quitclaim Deed
covering a portion of an access/drainage easement, across Assessor’s Parcel Number
126-210-045, located on Detroit Avenue in Concord, pursuant to Government Code Section
25526.5.
APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute the Quitclaim
Deed on behalf of the Contra Costa County Flood Control and Water Conservation District
(District).
DIRECT the Real Property Division to have the above referenced Grant of Easement
recorded in the office of the County Recorder and deliver a certified copy of this Board
Order and the Quitclaim Deed to Baywood Land Management for the purpose of
completing real property transactions in compliance with the California Environmental
Quality Act (CEQA), and
APPROVE OTHER

Subject:Accept Grant of Easement from Baywood Land and convey the Quitclaim Deed, Concord area. Project No.:

ADOPT the previously certified City of Concord Negative Declaration for the purpose of
right of way conveyance between the District and Baywood Land Management in
compliance with the California Environmental Quality Act,
RECOMMENDATION(S): (CONT'D)
and
DIRECT the Director of the Department of Conservation and Development (DCD) to file
a Notice of Determination with the County Clerk, and
AUTHORIZE the Chief Engineer to arrange for payment of a $25.00 fee to DCD for
processing, and a $50 fee to the County Clerk for filing the Notice of Determination.
FISCAL IMPACT:
There is no impact to the County General Fund. Costs paid by applicant. Account: 3540
BACKGROUND:
Baywood Land Management is conveying a Grant of Easement over a portion of APN
126-210-045, which recorded on March 27, 2009, under Recorder Series Number
2009-0065134 in exchange for a quitclaim deed from the District over a portion of land
within the same APN, which recorded September 23, 1969, in Book 5966, Page 253 of
Official Records. The areas described need to be exchanged in order for the District to
continue to have access and maintenance to a portion of Galindo Creek.
CONSEQUENCE OF NEGATIVE ACTION:
The District will not have sufficient land rights for access and maintenance of Galindo
Creek.
