Adopt a motion to grant the second request by Palmer Madden and Susan Paulus to extend
the period for filing a Parcel Map for the approved Vesting Tentative Map, County File
#MS0400008 by twelve (12) months to August 9, 2014.
FISCAL IMPACT:
There is no fiscal impact. The applicant has paid fees to process this project and is obligated
to pay supplemental fees for staff time and material costs which exceed 100% of the initial
fee payment.
BACKGROUND:
In 2005, the Board of Supervisors approved a Vesting Tentative Map to subdivide a
5.8-acre parcel into three parcels located off of Las Trampas Road in the Alamo area.
Following the approval, the subdividers requested, and the Board granted, an extension of
the period for filing the required parcel map. The subdividers are currently seeking the
Board's authorization of a second extension of the period for filing a final parcel map.
The property is zoned P-1 (Planned Unit District), with General Plan designations of

Subject:Request to Extend the Filing of an Approved Vesting Tentative Map (County File MS040008) for a Property
Located at 1900 Las Trampas Road in Alamo.
Agricultural Lands (AL) and Single –Family Residential-Very Low Density (SV). The
property lies in a transitional area between smaller residential parcels to the east and larger
parcels to the west, and mid-way between the valley floor and the higher ridgeline of Las
Trampas Ridge. To the northeast side of the property is the Jones Ranch residential
development, which has been established. The hillside area adjoining the subject site is a
common and deed-restricted area for the adjacent residential neighborhood.
On March 24, 2004, the property owners, Susan Paulus and Palmer Madden filed an
application requesting approval of a Vesting Tentative Map to subdivide the property into
three (3) parcels. The minor subdivision application was filed concurrently with an
application to rezone the property to a Planned Unit District (County File # RZ043144), and
an application for a Final Development Plan (County File #DP043025). The parcels range in
size from 1.3-2.8 acres.

Approval of Vesting Tentative Map
On May 25, 2005, the project was initially heard and approved by the San Ramon Valley
Regional Planning Commission, subject to the conditions. To address potentially
significant adverse impacts to the habitat of a special-status species, the Alameda
Whipsnake, the approval was conditioned to require that prior to filing a parcel map or
development of the site, the subdivider must prepare plans and obtain the approval of the
United States Fish and Wildlife Service and California Department of Fish and Game to
provide for the protection, replacement and management of this habitat. Additionally, to
assure the project's compatibility with the surrounding area, the size (floor area) of
residences is restricted.
The applicants had objected to some other conditions that the Planning Commission
imposed, and appealed the Commission’s decision to the Board of Supervisors. On
August 9, 2005, the Board of Supervisors conducted a hearing on the appeal, and
approved the project with the modifications sought by the subdivider. By provision of the
Subdivision Ordinance, the Board's approval of the vesting tentative map allowed the
subdivider three years, until August 9, 2008, to file the required parcel map.
Prior to the expiration date for the minor subdivision approval, the property owners
submitted a request to extend the period to file a parcel map for an additional five (5)
years. On April 8, 2008 the Board of Supervisors approved a five (5) year extension of
the period for filing the parcel map to August 9, 2013.
Within the last couple of years, the State Legislature has amended the Map Act to grant
extensions of the period for filing a parcel/final map from five years to up to a total of six
years.
Current Request
On January 14, 2010 the property owners submitted a second request to further extend
the period for filing a parcel map. In the letter requesting this second extension, the
property owners indicate that the cost of complying with the conditions would possibly
result in selling some or all of the property. Mr. Madden and Ms. Paulus would like to
reside on and use the entire property until circumstances require them to do otherwise.
The Subdivision Map Act allows for extension by an advisory agency authorized to
approve or conditionally approve tentative maps for a period or periods not exceeding a
total of six (6) years upon receipt of an application from the subdivider filed prior to the
expiration of the approved tentative map [Government Code § 66452.6 (e)].
If the Board grants this request, then the Map Act would allow no future filing period
requests to be granted.
