APPROVE and AUTHORIZE the Conservation and Development Director, or her
designee, to execute an amendment to the Interagency Agreement with the City of
Richmond to oversee implementation of the North Richmond Waste and Recovery
Mitigation Fee Expenditure Plan, to extend the term through June 30, 2012 with no change
to the payment limit. (Contract #C49335)
FISCAL IMPACT:
No impact to the County General Fund. The cost of the agreement is being paid using
Waste and Recovery Mitigation Fee funding which Republic Services is required to pay
monthly for materials accepted at the Bulk Material Processing Center (including the
Golden Bear Transfer Station/Waste Recycling Center) located at the West Contra Costa
Sanitary Landfill in the North Richmond area.
BACKGROUND:
Republic Services began collecting and paying to the County a per ton Waste and Recovery
Mitigation Fee (“Mitigation Fee”) in February 2006, which is subject

BACKGROUND: (CONT'D)
to the joint-control of the City and County, pursuant to the requirements of the Land Use
Permits for the West Contra Costa Sanitary Landfill (“WCCSL”) Bulk Materials
Processing Center (“BMPC”), which includes the Golden Bear Transfer Station/Waste
Recycling Center.
In July 2004, the City of Richmond (“Agency”) and Contra Costa County entered into a
Memorandum of Understanding (“MOU”) agreeing to jointly administer Mitigation Fees
collected from the WCCSL BMPC, for the benefit of the incorporated and
unincorporated North Richmond area. The MOU requires that the Mitigation Fee monies
be paid to the County and held in a designated account. A Committee was formed
pursuant to the terms of the MOU for the specific purpose of preparing a recommended
two year Expenditure Plan which is subject to final approval of the Richmond City
Council and the Contra Costa County Board of Supervisors. This Expenditure Plan
provides a means for the City and County to jointly administer the Mitigation Fee
funding for the benefit of the host community, as described in the BMPC Draft
Environmental Impact Report dated November 2003.
“Expenditure Plan” refers to the City and County approved version of the North
Richmond Waste and Recovery Mitigation Fee Expenditure Plan covering a two year
funding cycle, which may be amended from time to time by the City Council and Board
of Supervisors. The third two year (2010-2011) Expenditure Plan was approved by the
Richmond City Council and the Contra Costa County Board of Supervisors in December
2009 and staff expects the 2010/2011 Expenditure Plan to be amended in early 2010 to
allocate additional funding to various strategies.
This contract provides a framework for the County to transfer Mitigation Fee monies to
the City for administrative staff costs related to the implementation and oversight of the
Expenditure Plan as well as other expenses directly related to each activity (“Strategy”)
described in the Expenditure Plan which the Agency will directly oversee/administer.
This agreement amendment provides an extension of the term to allow the City to
continue administering various ongoing Strategies carried over from prior approved
Expenditure Plan cycle as well as additional new Strategies.
