Approve and authorize the Health Services Director, or his designee (Haven Fearn), to
accept on behalf of the County, Grant Award #29-530-1 (Z0-09-01-0070) from California
Emergency Management Agency (Cal EMA) to pay the County an amount not to exceed
$1,179,420 for the County’s Alcohol and Other Drugs Services Division, Recovery Act
Justice Assistance Grant, Substance Abuse Offender Treatment Program (JAG-OTP), from
the period from October 1, 2009 through March 31, 2011.
FISCAL IMPACT:
Approval of this grant will result in a total of $1,179,420 of American Recovery and
Reinvestment Act (ARRA) funding administered by the California Emergency Management
Agency (Cal EMA), through March 31, 2011. No County match required.
BACKGROUND:
In the year of 2000, the voters approved Proposition 36, the Substance Abuse and Crime
Prevention Act (SACPA). Passage of this measure added sections 1210, 1210.1 and 3063.1
to the California Penal Code, thereby permitting referral to treatment for nonviolent drug
offenders

in lieu of criminal sentencing or return to custody in the case of parolees. In fiscal year
2006-2007, the Offender Treatment Program (OTP) was implemented, shifting some funds
from SACPA to a program intended to produce better client outcomes. In fiscal year
2009-2010, the State Budget Act eliminated Proposition (Prop 36). Nevertheless, the
sentencing provisions in the Penal Code remained and Contra Costa County courts and
parole services continued to refer qualifying offenders to treatment. At present, there is
inadequate capacity to provide treatment for person referred under Prop 36. Potential clients
are placed on a waiting list and the show rate for admission had dropped precipitously.
Offenders who can be helped through substance treatment to achieve sobriety and recovery
and break the cycle of recidivism are not able to find that help. The JAG-OTP funding will
enable a partial reconstruction of the Substance abuse offender treatment system in Contra
Costa County.
On March 9, 2010, the Board of Supervisors approved submittal of Application #29-530
from California Emergency Management Agency (Cal EMA). Approval of Grant Award
#29-530-1 will allow the County of provide treatment services for the Offender Recovery
Project including, but not limited to increasing the proportion of offenders who enter,
remain in, and complete treatment; reduce delays in the availability of appropriate services;
and employ a drug court model, including dedicated court calendars with regularly
scheduled reviews of treatment program, and strong collaboration by the courts, probation
and treatment, through March 31, 2011.
