APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a
novation contract with Condor Country Consulting, effective November 1, 2007, in an
amount not to exceed $700,000 to provide environmental assessments for the Vasco Road
Safety Improvements Project, Brentwood and Byron areas. (100% Proposition 1B Funds),
FISCAL IMPACT:
There is no impact to the County General Fund. This project is funded by Proposition 1B
Funds.
BACKGROUND:
Effective November 1, 2007, on behalf of the Contra Costa County (County), the Public
Works Department (Department) entered into a two-year Consulting Services Agreement
(CSA) contract with Condor Country Consulting (Condor) in an amount not to exceed
$250,000 for environmental consulting services for the Vasco Road Wildlife Movement
Studies. The CSA also, had two subsequent amendments which included; a project name
change to Vasco Road Safety Improvements Project, a one-year extension, additional scopes
of work due to Federal Stimulus Package funding, and two payment

limit increases totaling $350,000; bringing the contract to a current payment limit of
$600,000.
Due to contracting changes, the CSA contract is no longer appropriate for this type of
work. Therefore, a novation contract was implemented onto the County’s Standard Long
Form contract to replace the original CSA contract and subsequent CSA amendments.
This novation contract includes an additional payment limit increase of $100,000 to a
new payment limit of $700,000 and additional provisions that apply to projects funded by
the United States Department of Transportation. This novation contract will include these
additional terms and will make the previous November 1, 2007, CSA contract and
subsequent amendments, void.
The Vasco Road Safety Improvement Project (project) is being implemented by the
Contra Costa County Public Works Department (Department) in response to many
serious, often fatal, vehicle collisions along Vasco Road, in East Contra Costa County.
The project has substantial community backing, as well as strong support from
Supervisor Piepho’s office. The Department originally entered into a Consulting Services
Agreement (CSA) with Condor Country Consulting (Condor) on December 1, 2007, to
provide Wildlife/Biological assessment services for the project. The project received
Federal funding (Federal Stimulus Package), which required additional special
environmental assessments and studies, pursuant to the National Environmental Policy
Act (NEPA); subsequently, the Contra Costa County Board of Supervisors approved
CSA Amendment No. 1, to accommodate the funding change, additional special
environmental Archaeological/Cultural-Historical assessments and studies, as required by
the National Environmental Policy Act (NEPA) Guidelines, as well as a one-year
extension, and a project name change (from Vasco Road Movement Study to the Vasco
Road Safety Improvement project).
The Board of Supervisors approved CSA Amendment No. 2 to increase the CSA amount
to accommodate additional unforeseen work, which included
paleontological/geo-archaeological assessments and additional wildlife/biological
assessment. The paleontological sensitive areas that were discovered during on-going
environmental assessments, added to the project’s area of potential affect (APE) that
required appropriate reconnaissance level field work and reporting with regards to
archaeological/cultural and biological/botanical resources. Further, to be compliant with
the Caltrans Standard Environmental Reference (SER), subsurface archaeological testing
and soil profiling was necessary in areas with young Holocene-aged sedimentary
deposits. Finally, the Wildlife Permeability Study required in support of the East Contra
Costa County Habitat Conservation Plan was substantially more rigorous than previously
anticipated and required numerous review cycles, production of many unanticipated
maps, engineering drawing details, and significant coordination with Deptartment
Environmental staff and consulting engineers.
Condor is certified as a Small Business Enterprise (SBE), Woman Business Enterprise
(WBE), and Disadvantaged Business Enterprise (DBE), and qualifies as Underutilized
Disadvantaged Business Enterprise (UDBE). The Department has determined that
Condor is qualified to conduct the necessary work for environmental compliance for the
project.
CONSEQUENCE OF NEGATIVE ACTION:
Without Board approval, environmental assessments will not be completed in a timely
manner and the necessary California Environmental Quality Act (CEQA), National
Environmental Policy Act (NEPA), and East Contra Costa County Habitat Conservation
Plan (HCP) clearances will not be obtained, which may delay the design and construction
of the Project and jeopardize funding.
