APPROVE and AUTHORIZE the Chief Information Officer (Department of Information
Technology) to execute a permit and license with the State of California, Administrative
Office of the Courts (AOC), granting the County permission to construct and maintain
(using its own or third party forces) facilities for the Sheriff’s use in providing a
communication system to the Court in the Courthouse, includes the County's agreement to
indemnify the AOC from and against the County’s share of liability arising out of the
performance of the related work, for howsoever long as the Sheriff and the Court have a
security agreement.
FISCAL IMPACT:
100% State AOC funding; no County cost.

Subject:PERMIT TO PERFORM CONSTRUCTION AT THE PITTSBURG COURTHOUSE
BACKGROUND: (CONT'D)
of the Judicial Branch of the State of California and the party responsible under the Trial
Court Facilities Act (Cal. Govt. Code 70301 et seq.) for the real property and the
construction of court facilities. The AOC is constructing the Richard E. Arnason Justice
Center (“Courthouse”) at 1000 Center Drive in Pittsburg. The Superior Court has contracted
with the Sheriff to provide security for the Court. In order to provide the security requested
by the Court, the Sheriff requires the construction and installation of certain
communications systems including a roof antenna and access to these facilities over time for
ongoing maintenance and upgrades. The subject permit and license will grant the County
permission to construct and maintain (using its own or third party forces) facilities for the
Sheriff’s use in providing a communication system to the Court in the Courthouse.
The permit and license includes the County's agreement to indemnify, defend and hold
harmless the AOC from and against County’s share of all loss, cost, damage, expense,
and/or liability arising out of the willful misconduct or the negligent acts, errors or
omissions of County, its officers or employees in the performance of the related work.
