APPROVE the Proposition 1B revised project list identifying the projects for funding with
Proposition 1B funds, as recommended by the Public Works Director, Countywide.
FISCAL IMPACT:
No impact to the General Fund. Contra Costa County is expected to receive a total of
approximately $24 million as part of Proposition 1B to fund road improvement projects. The
County has already received approximately $13.3 million in Proposition 1B funds and is
expected to receive an additional $10.7 million with the final 2009/2010 Appropriation.
BACKGROUND:
In 2006, Governor Schwarzenegger signed a $37.3 billion package of bonds for highways,
schools, levees and affordable housing. The package contained several components
including Senate Bill 1266 (SB 1266), the Highway Safety, Traffic Reduction, Air Quality
and Port Security Bond Act of 2006. The act, approved by the voters as Proposition 1B at

election, authorizes the issuance of $19.9 billion of general obligation bonds to fund a
variety of transportation priorities including reducing emissions and improving air quality
in trade corridors, highway-railroad grade separation and crossing improvement projects,
state highway safety and rehabilitation projects, and local street and road improvements,
congestion relief, and traffic safety projects. In addition to Proposition 1B, four other
bond measures known as Proposition 1A (Proposition 42 protection), Proposition 1C
(housing), Proposition 1D (education) and Proposition 1E (levees and flood protection)
were included on the ballot. Of the $19.9 billion, $2 billion is designated for cities and
counties to fund the maintenance and improvement of local transportation facilities. The
specific allocation for each agency is based on the number of registered vehicles and the
number of miles of road. Based on that formula, Contra Costa County (unincorporated) is
expected to receive $24 million over the life of the program. On October 10, 2006, in
anticipation of the voters passing the Senate Bill 1266 (SB 1266), the Highway Safety,
Traffic Reduction, Air Quality and Port Security Bond Act of 2006, known as
Proposition 1B, the Public Works Department presented a plan to the Board of
Supervisors for projects to be funded by the bond proceeds. The 2007 Budget Act and
Chapter 181, Statutes of 2007, Senate Bill 88 (SB88), included the first installment of
$950 million of the Proposition 1B funds for State fiscal year 2007-08 for cities and
counties. Contra Costa County's share for fiscal year 2007-08 was $9.7 million. Chapter
39, Statutes of 2008 (AB 1252), appropriated an additional $87 million in Proposition 1B
funds specifically to counties. These funds are referred to as the 2008 Supplemental
Appropriation for Counties. Of this $87 million, Contra Costa County's share was
approximately $2.1 million. The 2008 Budget Act appropriated a total of $250 million of
the Proposition 1B funds for State fiscal year 2008-09 for cities and counties. Contra
Costa County's share for fiscal year 2008-09 was $1.5 million. The 2009 Budget Act
appropriates a total of $700 million in Proposition 1B funds for State fiscal year 2009-10,
which represents the remaining balance of the Proposition 1B Local Streets and Roads
funding. Of this amount, Contra Costa County's share is $10.7 million. In order to receive
funds, counties and cities must submit a plan to the Department of Finance for use of the
amount of funds available in State fiscal year 2009-10. The program allows three
subsequent fiscal years to expend the funds from the date that the funds are allocated by
the State Controller, and any funds not expended within that period will be returned and
reallocated to other cities or counties. The funds are to be used for improvements to
transportation facilities that will assist in reducing local traffic congestion and further
deterioration, improving traffic flows, or increasing traffic safety. The following table
(Exhibit A) shows the revised project list, how Proposition 1B funds will be allocated,
and how the remaining 2009-10 allocation of $10.7 million will be distributed.
CONSEQUENCE OF NEGATIVE ACTION:
The revised project list for the Proposition 1B allocation will not be accepted by the
Board and County will not receive Proposition 1B funds. Additionally, the projects
indicated on the revised plan will not be fully funded and will not be able to continue.
