HomeMy WebLinkAboutMINUTES - 04132010 - C.1 (2)RECOMMENDATION(S): APPROVE the conveyance of an ingress & egress easement to State of California, Department of Transportation (Caltrans) for maintenance of a pump station on State Route 4, and pursuant to Streets & Highway Code § 960. AUTHORIZE the Chair, Board of Supervisors, to execute an Easement Deed on behalf of Contra Costa County (County), as recommended by the Public Works Director. DIRECT the Real Property Division of the Public Works Department to cause said Easement Deed to be delivered to the grantee for acceptance and recording. FISCAL IMPACT: There is no impact to the County General Fund. The property acquisition was funded by Contra Costa Transportation Agency (CCTA) (100%). (CDD-CP #00-85) Project No. 4660-6X4287 BACKGROUND: The County Public Works Department acquired the real property on October 4, 2001 in the City of Pittsburg, described in Exhibit "A" attached hereto, for State Route 4 Railroad to Loveridge project. Caltrans requires a perpetual non-exclusive floating easement for ingress and egress over the property for personnel, vehicles and equipment for access to the new pump station constructed north of the parcel described in Exhibit “A”. The remaining fee property will be granted to Bay Area Rapid Transit District (BART) as part of the Pittsburg Park and Ride Lot. CONSEQUENCE OF NEGATIVE ACTION: Caltrans would not have the necessary land rights for maintaining a pump station located on State Route Highway 4 and the final project would not be according to approved plans and specifications.
