Department of Information Technology (0060) in the amount of $2 million from the
General Fund-Reserve For Contingencies (Capital Reserve) and appropriate for the
negotiation of acquisition of the Kregor Peak property, and AUTHORIZE the Real
Property Division, Public Works Department on behalf of Contra Costa County
(County), to negotiate a Purchase and Sales Agreement between the County and
Grantors for the Kregor Peak property.

Subject:Appropriation for Negotiation of Acquisition of Property - Kregor Peak/Pittsburg
RECOMMENDATION(S): (CONT'D)
FIND that the Project has been determined to be exempt from the California
Environmental Quality Act (CEQA) under State CEQA guidelines pursuant to Article 5,
Section 15061 (b)(3), and DIRECT the Director of the Department of Conservation and
Development to file a Notice of Exemption with the County Clerk, and AUTHORIZE the
Public Works Director, designee, to arrange for payment of a $25.00 fee to Conservation
and Development for processing, and a $50.00 fee to the County Clerk for filing the
Notice of Exemption.
FISCAL IMPACT:
This action appropriates $2 million from the General Fund Capital Reserve. No
reimbursement is anticipated.
BACKGROUND:
The Edna Hanlon Thomas Trust (Trust) previously owned land south of the City of
Pittsburg, California, a portion of which is leased to County for use by the County as a
communication site. That communication site is known to the County as the Kregor Peak
Communication Site (Kregor Peak). The Trust had been managed by Mr. William Wayne
Thomas. Upon Mr. Thomas’s death in 2008, it is the County’s understanding that the
Trust was dissolved, and title to Kregor Peak and the surrounding property is now shared
by 18 ownership interests.
Kregor Peak is approximately one acre in size with a 53,053 square feet (1.22 acre)
access easement. The site has been improved with two buildings and two communication
towers. The County owns the improvements and is currently leasing the property. The
Kregor Peak radio site is operated by the County and is used predominately for public
safety purposes by Contra Costa County Sheriff and Fire Department, East Bay Regional
Parks Police and Fire departments, and American Medical Response (AMR). Other users
include the Contra Costa Water District, Mount Diablo School District, Tri Delta Transit,
Caltrans, State of California, and the Contra Costa County Library. Kregor Peak is also a
key site for the build out of the East Bay Regional Communications System (EBRCS). If
Kregor Peak is no longer available to serve as one of the County’s six high level sites, we
have estimated that it would require several high and mid level sites to replace the
geographical coverage that Kregor Peak currently provides.
Negotiating for and acquiring Kregor Peak will allow the County to maintain the current
radio system service levels. In addition, it will allow the County to continue building this
site as one of the key EBRCS radio sites.
The purchase of this property is exempt from CEQA under state CEQA guidelines
pursuant to Article 5, Section 15061 (b)(3).
CONSEQUENCE OF NEGATIVE ACTION:
Without adequate appropriations, successful negotiation cannot take place.
CLERK'S ADDENDUM
APPROVED the appropriation adjustment; AUTHORIZED the Real Property Division
to negotiate a Purchase and Sales Agreement to acquire the Kregor Peak
Communication Site; FOUND the project to be exempt from California Environmental
Quality Act (CEQA) pursuant to Article 5, Section 15061 (b)(3); DIRECTED the
Director of the Department of Conservation and Development (DCD) to file a Notice of
Exemption with the County Clerk; and AUTHORIZED the Public Works Director or
designee to arrange for payment of a $25 processing fee to DCD and a $50 fee to the
County Clerk for filing the Notice of Exemption.
