HomeMy WebLinkAboutMINUTES - 03232010 - C.116RECOMMENDATION(S): ADOPT Resolution finding that the Negative Declaration prepared for the Pittsburg/Bay Point Enterprise Zone and adopted by the City of Pittsburg (Lead Agency), is adequate for the purposes of compliance with the California Environmental Quality Act (CEQA) and adopting the Negative Declaration as the Responsible Agency. DIRECT the Department of Conservation and Development to file a Notice of Determination and pay the filing fee to the County Clerk. FISCAL IMPACT: NONE to the County. The cost associated with the administration of the Enterprise Zone program is budgeted in the 2009/10 Bay Point Redevelopment Agency budget. The application was submitted to the California Housing and Community Development (HCD) Department in March 2009. HCD conditionally approved the designation of the Pittsburg/Bay Point Enterprise Zone on August 19, 2009 and on September 30, 2009 HCD provided a list of conditions to the City and County to be completed and submitted by March 30, 2010. Included in the conditions was to comply with the CEQA. For the purposes of CEQA, the City of Pittsburg is the Lead Agency and Contra Costa County is a Responsible Agency. The City of Pittsburg adopted the Negative Declaration on February 16, 2010. CONSEQUENCE OF NEGATIVE ACTION: Without adoption of the Negative Declaration by March 23, 2010, the City and County will be unable to meet Conditions set by HCD and will be ineligible for the Enterprise Zone designation.
