HomeMy WebLinkAboutMINUTES - 03232010 - C.76RECOMMENDATION(S): APPROVE AND AUTHORIZE the Clerk-Recorder, or designee, to execute an addendum to the Memorandum of Understanding with the Department of Justice for county participation in the Electronic Recording Delivery System Program. The addendum is for the period July 1, 2010 through June 30, 2011 FISCAL IMPACT: There is no impact to the County General Fund for this program. It will be funded by dedicated Electronic Recording Trust Fund monies (2454). The cost is determined annually based on the number of real property documents recorded in previous year. Contra Costa's share for FY 2009/2010 is $14,181.98. BACKGROUND: On November 1, 2005 (C.57), the Board approved and authorized the Clerk-Recorder to participate in the California Electronic Recording Delivery Program and to enter into a Memorandum of Understanding with the Department of Justice for oversight of the program. AB578, G.C. 27393, requires the Attorney General to develop regulations for review, approve and oversight of the California Electronic Recording Delivery Program. Gov. Code 27397 requires any county that establishes an electronic recording system to pay the Department of Justice (DOJ)/Attorney General for the cost of regulation and oversight of the program. This Memorandum of Understanding permits Contra Costa to pay the DOJ/Attorney General each year for its proportionate cost of developing and implementing the California Electronic Recording Delivery Program. CONSEQUENCE OF NEGATIVE ACTION: Service to residents will not improve if Contra Costa does not participate in the California Electronic Recording Delivery Program.
