APPROVE a First Lease Amendment with 2005 Heydayian/Nouri Family Trust, to extend the Lease for a two (2) year term beginning April 1, 2010 and ending March 31, 2012, for approximately 10,000 square feet of office space at 600, 610, and 618 Main Street, Martinez, for the continued occupancy by the Department of Conservation and Development and the Contra Costa Historical Society, under the terms and conditions more particularly set forth in the First Lease Amendment. 2. AUTHORIZE the Director of General Services, or designee, to EXECUTE the First Lease Amendment on behalf of the County, and EXERCISE any additional options to the First Lease Amendment. 3. DETERMINE that the project is a Class 1(a) Section 15301 Categorical Exemption under the California Environmental Quality Act (CEQA). (CP# 10-06) 4. Lango, General Services Director Date:March 23, 2010 Contra Costa County Subject:FIRST LEASE AMENDMENT FOR THE PREMISES AT 600, 610, AND 618 MAIN STREET, MARTINEZ FOR THE DEPARTMENT OF CONSERVATION AND DEVELOPMENT Services, or designee, to arrange for the payment of the handling fees to the Department of Conservation and Development Director and the County Clerk for RECOMMENDATION(S): (CONT'D) filing of the Notice of Exemption. FISCAL IMPACT: The First Lease Amendment will obligate the County to pay a total rent of $150,000 over the two (2) year term of the lease, unless the lease is terminated earlier. The Lease costs were anticipated and budgeted in the Department of Conservation and Development’s FY 2010/2011 budget. BACKGROUND: The County has occupied this building since 2000. The Department of Conservation and Development (DCD) currently occupies half of the space, and the other half is subleased to the Contra Costa Historical Society. The County is currently working to renovate the County-owned buildings at 30 and 40 Muir Road in Martinez for DCD's occupancy. This First Lease Amendment will provide for DCD's continued occupancy at the 600 - 618 Main Street location until the renovation of the 30 and 40 Muir Road buildings is complete. The First Lease Amendment contains a termination clause that will allow the County to terminate the 600 - 618 Main Street lease after one year with 120 days notice if the 30 and 40 Muir Road renovations have been completed. The Historical Society's occupancy will be considered separately. CONSEQUENCE OF NEGATIVE ACTION: The Department of Conservation and Development would realize unknown capital costs and expenses in relocating to other premises in the Martinez area.
