APPROVE and AUTHORIZE the Chair, Board of Supervisors, to execute the third
amendment to the cooperative agreement dated February 15, 1994 between the Contra
Costa Water District (District) and Contra Costa County (County) as part of the Vasco Road
Replacement project.
ACCEPT the sum of $80,000 as a final payment (Final Payment) for staff costs incurred by
the Public Works Department in connection with the acceptance of the relocated Vasco
Road into the County-Maintained Road System.
ACCEPT a Quitclaim Deed from the District for under crossing easements under the
relocated Vasco Road after receipt of the Final Payment, and DIRECT the Real Property
Division to have the Quitclaim Deed recorded in the Office of the County Recorder.
FISCAL IMPACT:
There is no fiscal impact to the General Fund. The Contra Costa County Public Works
Department will be reimbursed $80,000 for staff costs incurred related to the acceptance of

Subject:Third Amendment to the Vasco Road Cooperative Agreement with Contra Costa Water District, Brentwood
area
Vasco Road into the County Maintained Road System.
BACKGROUND:
In 1994, the District constructed the Los Vaqueros Reservoir project. In order to
construct the reservoir, a portion of existing Vasco Road was relocated and a new section
of roadway (Replacement Roadway) was constructed that included various
undercrossings.
A Cooperative Agreement (Agreement) was entered into on February 15, 1994 between
the District and the County to provide for the design, construction, ownership, and
maintenance of the Replacement Roadway. Since then the Agreement was amended once
on April 2, 1996 and a second time on November 19, 1996.
On October 8, 2008 the County accepted all rights and responsibility for the
Replacement Roadway and its maintenance with the exception of five undercrossings
which the District currently holds as easements.
The County and the District desire to further amend the Agreement to allow the District
to quitclaim to the County its easement rights for the six under crossings. This third
amendment will also obligate the County to grant easements to adjacent property owners
to use the under crossings (including, if requested, permanent, irrevocable easements)
upon request from such property owners and upon mutually agreeable terms. Acceptance
of the Quitclaim Deed will result in the County assuming increased responsiblity and
liability.
In addition the County and the District desire that the Agreement be amended to require
the District to pay the County within 5 days of the approval and execution of this Third
Amendment to the Cooperative Agreement $80,000 as final payment for the
Replacement Roadway.
CONSEQUENCE OF NEGATIVE ACTION:
If the Agreement is not finalized, the County will not be reimbursed the $80,000 as final
payment for the Replacement Roadway and responsibility for maintenance of the
undercrossings will remain with the District.
