DELIBERATION ITEMS D. 1 HEARING to consider the proposed formation of Zone 3111 of County Service Area P-6 in the unincorporated area of El Sobrante. (Supervisor Gioia) Chair Gioia called for public comment. Tim Ewell, County Administrator’s Office, presented the staff report. Mr. Ewell informed the Board that at the time of this hearing, 75 protests had been received, of which 54 were registered voters in Contra Costa County; a majority protest does not exist. Chair Gioia called for public comment. The following people spoke: E. By unanimous vote the Board: CLOSED the hearing on the proposed formation of Zone 3111 within County Service Area P-6; DETERMINED no majority protest exists of the voters residing within the boundaries of proposed Zone 3111 exists pursuant to Government Code section 25217.1(b)(1); and ADOPTED Resolution No. 2010/126 establishing Zone 3111 of County Service Area P-6 subject to voter approval of a special tax to fund police protection services within the zone. Vote: 5 - 0 D. 2 HEARING to consider adoption of Ordinance No. 2010-03, authorizing the levy of a special tax for police protection services in Zone 3111 of County Service Area P-6 and FIXING of election. (Supervisor Gioia) Following the staff report, Chair Gioia called for public comment. Chair Gioia clarified that the ordinance does not institute a tax, rather it sets the fee amount and authorizes collection on the tax roll in the event the ballot measure to form the zone passes. The ordinance goes into effect only if the voters approve the formation of the zone in the June 8, 2010 election. By unanimous vote with all Supervisors present, the Board: CLOSED the hearing to consider adoption of Ordinance No. 2010-03, authorizing the levy of a special tax for police protection services in Zone 3111 of County Service Area P-6 in the unincorporated area of El Sobrante; ADOPTED Ordinance No. 2010-03; ADOPTED Resolution No. 2010/127 authorizing an election in Zone 3111 of County Service Area P-6 to consider approval of Ordinance No. 2010-03; and DIRECTED the County Clerk, Elections Division, to conduct the election required by Government Code sections 23027 and 53978. This election shall be held at the time of the primary election on June 8, 2010. Vote: 5 - 0 D. 3 CONSIDER accepting a report from Contra Costa Health Services on the history and accomplishments of system redesign and safety and quality improvement at Contra Costa Regional Medical Center. Closed Session CONSENT ITEMS Road and Transportation C. 1 ADOPT Resolution No. 2010/112 approving and authorizing the Public Works Director, or designee, to file applications for the federal Jobs for Main Street Act of 2010 funding for the Vasco Road Overlay Project and for the Vasco Road Safety Improvements Project and stating local support and assurances to complete the projects, Brentwood area. (No impact to General Fund) Vote: 5 - 0 Engineering Services C. 2 ADOPT Resolution No. 2010/122 approving and authorizing the Public Works Director, or designee, to continue full closure of a portion of West Griffon Street, through December 31, 2010, 24 hours per day, for the purpose of security fencing for material storage and housing under construction, Danville area. (No Fiscal Impact) Vote: 5 - 0 C. 3 ADOPT Resolution No. 2010/123 approving Stormwater Management Facilities Operation and Maintenance Agreement for DP 07-03064 (APN 148-480-014), as recommended by the Public Works Director, Walnut Creek area. (No Fiscal Impact) Vote: 5 - 0 Special Districts & County Airports C. 4 ADOPT Resolution No. 2010/125 approving and authorizing the Public Works Director, or designee, to execute a Master Grant Contract with the East Bay Regional Park District under the Measure WW Park Bond Extension in the amount of $2,493,336 for park improvement projects for the period March 2, 2010 through December 31, 2018, Alamo, Clyde, El Sobrante, San Pablo and Rodeo areas. Vote: 5 - 0 Appropriation Adjustments C.12 Employment and Human Services (Various) : APPROVE Appropriations and Revenue Adjustment No. 5053 authorizing mid-year revenue and appropriation adjustments resulting from reallocated State revenue, decreased American Recovery and Reinvestment Act (ARRA) revenue, and decreased Realignment revenue for FY 2009/10. Vote: 5 - 0 Grants & Contracts APPROVE and AUTHORIZE execution of agreements between the County and the following agencies for receipt of fund and/or services: C.13 APPROVE and AUTHORIZE the General Services Director, or designee, to submit an application and EXECUTE a loan agreement, if approved, for $2.5 million with the California Energy Commission to implement energy efficiency projects. (No County match) Vote: 5 - 0 C.15 APPROVE and AUTHORIZE the Health Services Director, or designee to execute a contract with John Swett School District, to pay County an amount not to exceed $600, for the Public Health Clinic Services Scoliosis Screening Project for 7th and 8th grade students, for the period February 1, 2010 through January 31, 2011. (No County funds) Vote: 5 - 0 C.16 APPROVE and AUTHORIZE the Health Services Director, or designee to execute a contract with Lafayette School District, to pay County an amount not to exceed $1,600, for the Public Health Clinic Services Scoliosis Screening Project for 7th and 8th grade students, for the period February 1, 2010 through January 31, 2011. (No County funds) Vote: 5 - 0 C.17 APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract amendment with the California Department of Public Health, Immunization Branch, to incorporate new supplemental terms and conditions regarding the American Recovery and Reimbursement Act funds, allowing the County to continue providing services for the Immunization Assistance Program, with no change in the original amount payable to the County of $527,578 and no change in the original term of July 1, 2009 through June 30, 2010. (No County match) Vote: 5 - 0 C.18 APPROVE and AUTHORIZE the Employment & Human Services Director, or designee, to execute a contract to accept funding from California Department of Education for School Age Resources in an amount not to exceed $1,166 for the period July 1, 2009 through June 30, 2010. (No County match) Vote: 5 - 0 APPROVE and AUTHORIZE execution of agreement between the County and the following parties as noted for the purchase of equipment and/or services: C.19 APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract amendment with Sharon Odom, MFT, effective February 1, 2010, to increase the payment limit by $7,000 to a new payment limit of $57,000, to provide additional Medi-Cal specialty mental health services, with no change in the original term of March 1, 2008 through June 30, 2010. (100% Medi-Cal Funds, offset 50% State and 50% Federal) Vote: 5 - 0 C.20 APPROVE and AUTHORIZE the Employment and Human Services Director, or designee, to issue a Request for Proposals on behalf of the Family and Children's Trust Committee in an amount not to exceed $250,000 for parent choice child care subsidies for low-income working families and/or families with unemployed parent(s) in school or in employment training programs, for the period July 1, 2010 through June 30, 2011. (100% County Child Care Affordability funds) Vote: 5 - 0 C.21 APPROVE and AUTHORIZE the Public Works Director, or designee, to execute a novation contract with Condor Country Consulting in an amount not to exceed $200,000 to provide on-call environmental consulting services on various projects, Countywide, for the period December 1, 2008 through December 31, 2011. (48% Flood Control & Water Conservation District, 48% Local Road, and 4% Airport Project Funds) Vote: 5 - 0 C.22 APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract amendment with On Assignment Staffing Services, Inc., effective February 17, 2010, to modify the rate schedule with no change in the original payment limit of $2,500,000 and no change in the original term of June 1, 2009 through May 31, 2010. (100% Enterprise Fund I) Vote: 5 - 0 C.23 APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract with Per Diem Staffing Systems, Inc. in an amount not to exceed $265,000, to provide temporary respiratory therapists at Contra Costa Regional Medical and Health Centers, for the period February 1, 2010 through January 31, 2011. (100% Enterprise Fund I) Vote: 5 - 0 C.24 APPROVE and AUTHORIZE the Employment and Human Services Director, or designee, to execute a contract with Larry Digman, in an amount not to exceed $163,300 to provide data warehouse analysis for the period April 1, 2010 through March 31, 2011. (20% County, 40% State, 40% Federal) Vote: 5 - 0 C.25 APPROVE and AUTHORIZE the Employment and Human Services Director, or designee, to execute a contract with Multilingual Counseling, Inc., in an amount not to exceed $150,000, to provide mental health services to adults and children who are not Medi-Cal eligible, and Medi-Cal eligible clients who do not have a mental health benefit, for the period March 1, 2010 through February 29, 2011. (100% County Funds) Vote: 5 - 0 C.26 APPROVE and AUTHORIZE the Purchasing Agent, or designee, to purchase, on behalf of the Sheriff-Coroner, one patrol vehicle in the amount of $25,068 for use by the Office of the Sheriff-Coroner- Discovery Bay Resident Deputy. (100% County Service Area P-6, Discovery Bay zone funds) RELISTED to an undetermined date. Vote: 5 - 0 C.27 APPROVE and AUTHORIZE the Purchasing Agent, or designee, to Purchase an additional vehicle for the Health Services Department. (Kaiser Permanente Grant funds) Vote: 5 - 0 C.28 APPROVE and AUTHORIZE the Employment and Human Services Director, or designee, to issue a Request for Proposals in an amount not to exceed $509,495 to provide intensive family preservation services in support of the Promoting Safe and Stable Families Program. (46.9% State, 33.0% Federal, 20.1% County General Fund) Vote: 5 - 0 C.29 APPROVE and AUTHORIZE the Purchasing Agent to execute, on behalf of the Health Services Department, a purchase order with Applied Remedial Services, Inc., in an amount not to exceed $260,000 for removal and disposal of hazardous waste materials at Contra Costa Regional Medical and Health Centers, for the period March 1, 2010 through February 28, 2011. (100% Enterprise Fund I) Vote: 5 - 0 C.30 APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract with Sodexo America, LLC, in an amount not to exceed $188,928 to provide management and oversight of the Environmental Services Unit at Contra Costa Regional Medical and Health Centers, for the period January 1 through June 30, 2010. (100% Enterprise Fund I) Vote: 5 - 0 C.31 APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract with New Connections, in an amount not to exceed $298,000, to provide services to County residents with HIV disease for the period March 1, 2010 through February 28, 2011. (100% Ryan White HIV/AIDS Treatment Modernization Act of 2006) Vote: 5 - 0 C.32 APPROVE and AUTHORIZE the Health Services Director, or designee, to execute a contract amendment with Community Options for Families and Youth, Inc., effective February 1, 2010, to increase the payment limit by $600,000 to a new payment limit of $1,800,000 to provide additional therapeutic behavioral services, with no change in the original term of July 1, 2009 through June 30, 2010; and to increase the automatic extension payment limit by $300,000 to a new payment limit of $900,000, with no change in the term through December 31, 2010. (62% Federal Medi-Cal, 33% State Early and Persistent Screening, Diagnosis, and Treatment, 5% Mental Health Realignment) Vote: 5 - 0 C.33 APPROVE and AUTHORIZE the Purchasing Agent to execute, on behalf of the Public Works Department, a purchase order with CompuCom Systems, Inc., in an amount not to exceed $232,793, for the purchase of software licensing applications for the period of November 1, 2009 to October 31, 2014 for both Public Works and Treasurer-Tax Collector. (88% Road and Flood Control Funds, 12% General Fund) Vote: 5 - 0 C.34 APPROVE and AUTHORIZE the Employment and Human Services Director, or designee, to execute contract amendments decreasing the total payment limit by $255,806 to a new total payment limit of $908,194, with the non-profit organizations listed below that provide Transitional Housing Assistance for Emancipated Youth, with no change in the term of July 1, 2009 through June 30, 2010. (100% Enterprise Fund I) Vote: 5 - 0 Other Actions C.35 ADOPT Resolution No. 2010/128 accepting as complete the contracted work performed by Rudolph Commercial Interiors, Inc. for the Renovation of the Health Services Building and ADA Upgrades Project, 2425 Bisso Lane, Concord, as recommended by the General Services Director. (No fiscal impact) Vote: 5 - 0 C.36 ADOPT Resolution No. 2010/129 accepting as complete the contracted work performed by Kel-Tec Builders, Inc. for the Homeless Shelter Expansion/Respite Care Clinic Project, 2047-D Arnold Industrial Way, Concord, as recommended by the General Services Department. (No fiscal impact) Vote: 5 - 0 C.37 ACCEPT the Contra Costa County Mobile Home Advisory Committee 2009 Annual Report, as submitted by the Committee. Vote: 5 - 0 C.39 DECLARE as surplus and AUTHORIZE the Purchasing Agent, or designee, to dispose of specified vehicles no longer needed for public use, as recommended by the General Services Director. Any disclosable public records related to an open session item on a regular meeting agenda and distributed by the Clerk of the Board to a majority of the members of the Board of Supervisors less than 72 hours prior to that meeting are available for public inspection at 651 Pine Street, First Floor, Room 106, Martinez, CA 94553, during normal business hours. All matters listed under CONSENT ITEMS are considered by the Board to be routine and will be enacted by one motion. There will be no separate discussion of these items unless requested by a member of the Board or a member of the public prior to the time the Board votes on the motion to adopt. Persons who wish to speak on matters set for PUBLIC HEARINGS will be heard when the Chair calls for comments from those persons who are in support thereof or in opposition thereto. After persons have spoken, the hearing is closed and the matter is subject to discussion and action by the Board.
