Approve and authorize the Health Services Director, or his designee, to execute, on behalf
of the County, Contract Amendment Agreement #26-856-27 with Diablo Pulmonary
Medical Group, effective November 1, 2009, to modify the Payment Provisions to reflect
the intent of the parties and to increase the Payment Limit by $22,000 from $290,000 to a
new total Contract Payment Limit of $312,000, with no change in the original term of
November 1, 2008 through October 31, 2011.
FISCAL IMPACT:
Funding for this Contract is 100% included in the Enterprise Fund I. Cost to the County
depends upon utilization.
BACKGROUND:
On December 16, 2008, the Board of Supervisors approved Contract #26-856-24 (as
amended by Amendment Agreement #26-856-26) with Diablo Pulmonary Medical Group,
for provision of internal medicine and pulmonary disease services including, but not limited
to, clinical coverage, sleep studies, consultation, training and medical and/or surgical
procedures, for Contra Costa

BACKGROUND: (CONT'D)
Regional Medical Center and Contra Costa Health Centers, for the period from November
1, 2008 through October 31, 2011.
County and the Contractor have agreed to modify the payment provisions to remove the
prior negotiated increases for Fiscal Years 2009/10 and 2010/11 and lock in the current
rates through October 31, 2011. In addition, based on an increase in patient volume,
Contractor has agreed to provide additional sleep studies.
Approval of Contract Amendment Agreement #26-856-27 will modify the Contract
Payment Provisions, to make the formal Contract consistent with the oral agreement, which
was negotiated with the Contractor and allow the Contractor to continue providing services
through October 31, 2011.
