HomeMy WebLinkAboutMINUTES - 02232010 - C.61RECOMMENDATION(S): APPROVE and AUTHORIZE the General Services Director, or designee, to execute, a Memorandum of Understanding with the California Judicial Council-Administrative Office of the Courts and the Contra Costa County Superior Court regarding the 4th Floor Remodel Project of Wakefield Taylor Courthouse. FISCAL IMPACT: None. The Court will pay for all of the remodeling work performed by County personnel and outside contractors. BACKGROUND: On November 19, 2009, the Board approved a set of agreements and deeds between the County, the Contra Costa County Superior Court (Court), and the Judicial Council of California, Administrative Office of the Courts (AOC), which documents related to the Family Law Center, the Wakefield Taylor Courthouse, and the County Finance Building. In addition, under the Settlement Agreement, the parties agreed to enter into a Memorandum of Understanding (MOU) for the AOC to pay the County to renovate the 4th floor of Wakefield Taylor. In the November 19, 2009 Board Order, staff informed the Board that the MOU was under development and would later be brought to the Board for approval. The MOU has now been negotiated, has been signed by the Court and the AOC, and is ready for Board approval. A copy of the MOU is attached to the Board Order as Exhibit “A.” Under the MOU, the AOC will pay the County for all costs of remodeling the 4th floor of the Wakefield Taylor Courthouse, which costs are estimated to be $563,452. The payment to the County covers compensation for all remodeling work performed by County personnel and outside contractors. Thus, the MOU is revenue neutral as to the County. Consistent with the Settlement Agreement previously approved by the Board, the General Services Director recommends that the Board approve the MOU and authorize its execution by the General Services Director or his designee. CONSEQUENCE OF NEGATIVE ACTION: If the remodeling work is not performed or is delayed, this could potentially affect the Court's ability to continue providing collection services for court-related fees and fines and other County fees under the existing Collection Services MOUs between the County and the Court. In addition, if the MOU is not approved, this would deprive General Services personnel of an opportunity to perform fully-compensated work and could be inconsistent with the previously-approved Settlement Agreement, which references an MOU for the AOC to pay the County to perform the remodeling work.
