ADOPT Resolution 2010/110 authorizing the Association of Bay Area Governments (ABAG) to accept funding from the California Energy Commission for a regional residential energy retrofit program – Retrofit Bay Area – and recognizing Contra Costa County as the local implementer of the program within Contra Costa County. 2. AUTHORIZE the Conservation and Development Director, or her designee, to complete, execute and submit all documentation necessary, including a Memorandum of Understanding with ABAG , in order to secure up to $1,117,432 of State Energy Program grant funding if awarded to ABAG by the California Energy Commission and implement approved grant activities in coordination with ABAG and Contra Costa cities. 3. FIND that the proposed grant activities to be implemented locally, including financial incentives for eligible home energy retrofit projects, are Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to Section15301 of the CEQA Guidelines applicable to projects involving minor alterations to existing structures and negligible or no expansion of an existing use. DIRECT the Department of Conservation RECOMMENDATION(S): (CONT'D) and Development to post the Notice of Exemption with the County Clerk. FISCAL IMPACT: This funding (appropriated through the American Recovery and Reinvestment Act of 2009) will be used to implement local components of a regional residential energy retrofit program intended to encourage and facilitate reduced energy use by participating homes which will help reduce greenhouse gas emissions. BACKGROUND: The Association of Bay Area Governments (ABAG) partnered with eight Bay Area counties, representing a total of 104 local governments in the San Francisco Bay Area, in submitting a $10.75 M application to the California Energy Commission (CEC) to fund residential energy retrofits. The application was in response to the CEC’s request for proposals for $95 M in State Energy Program (SEP) funds to be awarded. ABAG received a notice of grant award from the CEC on Feb. 10, 20010. This regional proposal - Retrofit Bay Area - will establish the infrastructure for a market-driven residential retrofit program. This self sustaining program will stimulate the economy and create jobs while transforming energy markets in California. Designed for scalability and transferability this program will create a model that can be replicated statewide and nationally. Retrofit Bay Area is a region-wide energy efficiency program proposed to retrofit 17,000 homes (single family and multifamily) to achieve reduction in home energy consumption, while creating 1,739 home energy retrofit jobs. The grant, if awarded, would include regional program development, local program development and implementation, evaluation, measurement, administration and reporting. Some of the grant funding will be used to implement regional program tasks and the remainder is expected to be allocated to each county-specific program based upon countywide population. Contra Costa County’s proposed budget allocation is $1,117,432. Within Contra Costa County, the County Department of Conservation and Development will operate the SEP grant program serving residents of the entire County. The grant program will build off the County’s experience operating existing home energy retrofit programs. The County’s program will offer subsidized home energy assessments and rebates on the cost of energy efficiency improvements to qualifying homeowners proposing to implement home improvement projects that achieve at least a 20% reduction in home energy consumption. The CEC requires all collaborating local jurisdictions to provide an authorizing resolution. The Resolution must be approved by the local jurisdiction’s Governing Authority. In addition, an agreement between the California Energy Commission and ABAG must be executed. Prior to the agreement being executed all partnering jurisdictions, including the County, will have to sign a memorandum of understanding (MOU) to coordinate program activities with ABAG. Funds will be released by ABAG to Contra Costa County as the program implementer for the cities within the County and the unincorporated area. CONSEQUENCE OF NEGATIVE ACTION: If the recommendations are not approved, the County would not be able to comply with the grant application requirements necessary to secure funding allocated under the State Energy Program and therefore Contra Costa jurisdictions could not be included in the Retrofit Bay Area program.
