DETERMINE the costs of all abatement work and all administrative costs to be $1,261.90 ORDER the itemized report confirmed and DIRECT it to be filed with the Clerk of the Board of Supervisors. ORDER the costs to be specially assessed against the above-referenced property and AUTHORIZE the recordation of a Notice Of Abatement Lien. BACKGROUND: Contra Costa County Ordinance Code Article 14-6.4 and Government Code Section 25845 authorize the recovery of abatement costs in public nuisance cases, the recordation of a Notice of Abatement Lien, and inclusion of abatement costs on the tax roll as a special assessment upon approval of the Board of Supervisors. The Notice to Comply was posted on the above-referenced property for a vacant structure whose premises contains waste, rubbish, debris and excessive vegetation and served on the property owner and all persons known to be in possession of the property by certified mail on August 24, 2009. The property owner did not file an appeal. The County Abatement Officer abated the nuisance on October 30, 2009. Property is listed in LIS/Rumba/Tax assessor computer system as 12 W Chesley Avenue, Richmond. The address on the house is 16. The property was identified in violation and posted with a Notice on August 24, 2009. The property owner contacted the county and stated he thought he purchased the house with 12 on it. Via email and phone messages the property owner was informed of the address discrepancy, and was given time to figure out how he came to own the wrong property. On September 21, 2009 the property owner informed the county that he has filed a claim with the title company for the property purchase mix up, and that the realtor would have the property cleaned in the meantime. More time was allotted to the property owner, but after no resolve the property was cleaned by the county on October 30, 2009. The property owner was billed for the actual cost of the abatement and all administrative costs. The bill was sent by first-class mail to the property owner on November 23, 2009. The property owner did not pay the bill within 45 days of the date of mailing. Notice of this Cost Hearing was sent to the property owner by certified mail by the Clerk of the Board – see Clerk of the Board’s mailing confirmation. CLERK'S ADDENDUM Chair Gioia called for comment on the matter. Nathan Seigal, owner of 12 W. Chesley Avenue, informed the Board he is not the owner of the property of 16 W. Chesley. Jason Crapo, Department of Conservation and Development, explained that there is a discrepancy in records as to the parcel number and address numbers of the properties and that clarification is being pursued.
