HomeMy WebLinkAboutMINUTES - 02092010 - C.30RECOMMENDATION(S): APPROVE and AUTHORIZE County Counsel or designee to execute, on behalf of Contra Costa County, an agreement for specialized professional services with Farella Braun + Martel LLP. FISCAL IMPACT: None. Farella Braun will be compensated by the Guidiville Band of Pomo Indians pursuant to the terms of the November 10, 2009, Intergovernmental Agreement between the County and the Guidiville Band. BACKGROUND: On December 17, 2009, the County was sued over the Board’s approval of the November 10, 2009, Intergovernmental Agreement between the County and the Guidiville Band. (The Coalition to Save Point Molate, et al. v. Contra Costa County Board of Supervisors, et al., Contra Costa County Superior Court Case No. N09-2030.) The Guidiville Band assigned the BACKGROUND: (CONT'D) law firm of Farella Braun + Martel LLP to represent the County in this lawsuit. In closed session on February 2, 2010, the Board of Supervisors consented to the legal representation of the County by Farella Braun in this litigation, acknowledged two potential conflicts of interest arising from Farella Braun’s representation of the County in this litigation, and waived the potential conflicts. The attached agreement memorializes the understanding between the County and Farella Braun regarding the firm’s provision of legal services to the County.
